Matrimonial property regime in Catalonia and buying property jointly

Separate property is the default in Catalonia: the property belongs to whoever is recorded as the buyer. The main limit is that the family home cannot be sold without the spouse's consent.

A matrimonial property regime is the set of rules on what each spouse owns, who manages the property, and how it is divided on divorce or death. In Catalonia, without a marriage contract, separate property (separación de bienes) applies: the default regime is set out in art. 231-10 of the Código civil de Cataluña (the Civil Code of Catalonia), Book II (Ley 25/2010). Each spouse owns and disposes of their own property, and what is bought with money belongs to whoever is named as the buyer. For a foreign couple this holds only if Catalan law applies to them: which law governs is determined by conflict-of-law rules, including EU Regulation 2016/1103, and that question is for the abogado (lawyer) to resolve.

Who owns the property under separate property?

Whoever is recorded as the buyer in the escritura (the public deed of sale). What is acquired for value during the marriage belongs to the spouse named as the titleholder (art. 232-3). If it is proved that the price was paid with the other spouse's money, a gift is presumed. For household movables in family use, ownership in equal halves is presumed.

A worked example, not a forecast and not a DNPI project. A couple buys a villa for 2 M€ in 50/50 shares, that is, 1 M€ each. One spouse contributed 1.5 M€ and the other 500 000 €. With this split, the extra 500 000 € looks legally like a gift to the second spouse. What this means for gift tax is for the asesor fiscal (tax adviser) to determine, not this article.

The conclusion is simple: the shares in the escritura should match the actual contribution, or the difference should be documented deliberately. More on the allocation of rights in a project: who owns the property in a joint project.

When is the spouse's consent needed for a transaction?

When the property is the family home, whatever the regime. The owner spouse cannot, without the other's consent, sell, mortgage or otherwise dispose of their right in the family home and in the furniture of ordinary use, even where only shares are involved (art. 231-9). Consent cannot be excluded by contract or given in general terms. The other spouse can challenge a transaction made without consent, if they live in that home, within four years of learning about it or of its registration.

For a buyer of a villa from a family in Catalonia there is a risk here: the seller's statement in the escritura that the property is not a family home protects the buyer only if the buyer acted in good faith and for value. A buyer who knew, or could reasonably have known, otherwise is not protected. What to check before the arras (reservation deposit): who lives in the property and whose consent is needed.

Which regimes exist and how is one chosen?

The regime is chosen by a marriage contract (capítulos matrimoniales) in an escritura pública, before or after the wedding (arts. 231-19 and 231-22). Against third parties it takes effect only after registration in the Registro Civil and, where needed, in other registers. The spouses can change the regime themselves.

RegimeWho owns whatArticles
Separate property (default)Each spouse owns their property and everything bought in their name232-1, 232-2, 232-3
Participation in gainsDuring the marriage the property is separate; when the regime ends, one spouse is entitled to share in the other's increase in assets232-13
Community of propertyEarnings, fruits and whatever the spouses declare common become common232-30, 232-31

A pact for the case of divorce, made before the wedding, is valid only if signed at least 30 days before it, and the notary must explain the consequences to each spouse separately (art. 231-20). For a joint purchase there is the pacto de supervivencia (survivorship pact): the spouses agree in the escritura itself that everything passes to the survivor. While both are alive, such a property cannot be sold or charged without the consent of both, and the share is not transferred to third parties (art. 231-15).

What does the regime change for an SL and for heirs?

SL shares held in the name of one spouse under separate property belong to that spouse. But a spouse who has done substantially more for the home, or worked for the other without pay, may claim compensation if the other's increase in assets is larger. The cap is a quarter of the difference between the increases, though a court may exceed it if the contribution was clearly greater (arts. 232-5 and 232-6). If, for example, one spouse's increase is 2 M€ and the other's 400 000 €, the compensation cap is 400 000 €; assets are counted at the moment the regime ends, so an SL stake owned by one spouse enters the calculation.

Succession is governed by Book IV: the legítima (forced share) is a quarter of the calculation base (art. 451-5, Ley 10/2008), and a widower or widow in need may receive up to a quarter of the net estate (cuarta viudal, art. 452-1). On how SL shares and the property pass on: inheriting an SL stake.

Who is this not for?

Those to whom Catalan law does not apply: for a couple with a foreign element the answer on the regime may be different, and the Catalan articles do not replace an analysis of the conflict-of-law rules here. Those who want a ready-made wording of a marriage contract: it depends on citizenship, place of residence and goals. Those who read the article as tax advice: gift and inheritance taxes are discussed with the asesor fiscal.

If you plan a purchase from 1 M€ as a couple or through an SL, prepare a written list of questions for the abogado before signing; the general sequence of steps is described in the investment guide. If the deal goes through a representative, see the notarial power of attorney for an investor.

Questions and answers

Which matrimonial regime applies in Catalonia if there is no marriage contract?

Separate property. It is set as the default regime in art. 231-10 of the Código civil de Cataluña. For couples with a foreign element, the applicable law is determined first.

Is the wife's or husband's signature needed to sell a villa registered in one name?

If the villa is the family home, yes, whatever the regime. Without consent or a court's authorisation, the transaction can be challenged for four years.

What does "a gift is presumed" mean in a purchase by two people?

If one spouse paid for the property with the other's money, the law starts from the position that it is a gift. The tax consequences are checked by the asesor fiscal.

Can the regime be changed after the wedding?

Yes. A marriage contract can be made or changed after the wedding too, but only as an escritura pública. Against third parties it takes effect after registration in the Registro Civil.
