Barcelona property tax map
The main taxes and filings at each project stage. Choose the asset column, then confirm the parties and actual use.
1. Acquisition
First determine the transaction regime: TPO or VAT + AJD.
Residential property
Resale housing
Catalonia’s general scale from 27 June 2025 is 10% up to €600,000, followed by 11%, 12% and 13% bands. A 20% rate may apply to large residential owners and certain whole-building acquisitions; reduced rates require all statutory conditions.
ATC · TPO rates ↗New housing
A first delivery by the developer normally carries 10% VAT (4% for qualifying protected housing) plus AJD. A VAT-taxable transfer normally uses AJ4 at 1.5%.
AEAT / ATC ↗Commercial property
First delivery or non-exempt transfer
The general VAT rate is 21% where the transaction is taxable and not exempt; the deed will normally add AJ4 at 1.5%.
BOE / ATC ↗Resale commercial property
If the transfer is VAT-exempt, TPO is considered. If the seller validly waives the exemption, VAT, possible reverse charge and AJ5 at 3.5% must be reviewed.
ATC · AJD ↗2. Ownership
Annual obligations depend on the owner, use and cadastral value.
Residential property
Municipal property tax
Annual tax based on cadastral value and the municipal rate. Check the current bill, reliefs and change of owner.
Barcelona · local taxes ↗Income or imputed income
A resident reports the property under IRPF; a non-resident individual may report rent or imputed income for an empty or personally used urban property on Modelo 210.
AEAT · non-resident property ↗Commercial property
Municipal property tax
IBI applies whether the owner occupies or rents the premises; the agreement determines whether the economic cost can be passed on.
Barcelona · local taxes ↗Owner taxation
A resident individual is taxed under IRPF, a non-resident under IRNR and a Spanish company under corporate income tax. The general 2026 corporate rate is 25%, with different rates for qualifying businesses.
AEAT · corporate rates ↗3. Rental
Income tax and VAT treatment must be reviewed separately.
Residential property
Residential letting
Exclusive residential use is normally VAT-exempt. Mixed use, certain corporate lettings or hotel-like services may carry 21% or 10% VAT.
AEAT · residential letting ↗Rental income
A non-resident normally uses Modelo 210. EU/EEA with effective information exchange: generally 19% with evidenced related expenses; others: generally 24% on a different base.
AEAT · Modelo 210 ↗Commercial property
Commercial letting
Shops, offices, warehouses and separate garages are not exempt: the landlord charges 21% VAT.
AEAT · commercial letting ↗Tax on the result
In addition to VAT, the owner reports the result under IRPF, IRNR or corporate tax; possible withholding by a business tenant must also be checked.
AEAT · non-resident property ↗4. Works and refurbishment
Treatment depends on the client, use, materials and permission route.
Residential property
Residential works
The general rate is 21%. The 10% rate applies only when all statutory conditions for qualifying residential works are met.
AEAT · property VAT ↗Permissions and construction
The municipality may charge ICIO and permission or notification fees; the base and reliefs depend on the ordinance and works budget.
Barcelona · tax ordinances ↗Commercial property
Commercial fit-out
Design, refurbishment and fit-out normally carry 21% VAT; recovery depends on taxable activity and valid invoices.
AEAT · property VAT ↗Changes to the asset
New-build declarations, horizontal division, change of use and certain registrable acts may trigger AJD; works also require ICIO and fee checks.
ATC · AJD codes ↗5. Sale and transfer
Seller and buyer have separate obligations.
Residential property
Capital gain
A resident reports the gain or loss under IRPF. If a non-resident sells, the buyer withholds 3% through Modelo 211 and the seller calculates the result on Modelo 210: it is a payment on account.
AEAT · 3% withholding ↗Municipal land value tax
IIVTNU on urban land must be checked. In Barcelona, inter vivos transfers are normally filed within 30 working days.
Barcelona · plusvalía ↗Commercial property
Sale result
Treatment depends on the seller; a non-resident sale carries the 3% withholding, while a company includes the result in corporate tax.
AEAT · 3% withholding ↗Transfer regime
The buyer again determines TPO or VAT + AJD; the seller checks plusvalía and tax on the result. Asset deals and share transfers require separate analysis.
ATC / Barcelona ↗Taxes that arise only in specific circumstances
Wealth tax
Tax residence, worldwide or Spanish assets, liabilities and the main-home exemption must be reviewed. Catalonia applies its own allowance and scale.
ATC · wealth tax ↗Solidarity tax on large fortunes
This state tax must be checked for personal net wealth above €3 million together with wealth-tax credit rules.
AEAT · ITSGF ↗Inheritance and gifts
A gratuitous property transfer requires review of the base, relationship, prior gifts, reliefs and municipal plusvalía.
ATC · inheritance and gifts ↗Company and activity
A company must review corporate tax, patrimonial-entity status, VAT recovery, IAE and local obligations. A company is not automatically the most efficient structure.
AEAT · corporate rates ↗This map covers the main taxes for a typical Barcelona/Catalonia property, not an individual tax computation. Before arras and the public deed, a tax adviser must confirm the parties, VAT/TPO regime, base, reliefs, forms and deadlines.
Three separate questions
Owning Spanish property does not by itself determine tax residence or replace an immigration route. The property-investment residence route was repealed for new applications by the 2025 reform; see the consolidated BOE text.
Before acquisition
- Obtain an NIE and verify all parties.
- Decide whether the buyer is an individual or a company.
- Prepare source-of-funds evidence.
- Check title, charges, leases, community fees, IBI, use and licences.
- Calculate tax from the transaction, tax base and buyer status.
Acquisition tax in Catalonia
The general TPO scale is progressive: 10% up to €600,000, then 11%, 12% and 13% bands. A 20% regime applies to large residential owners and certain whole residential-building acquisitions. Check the current conditions and exceptions on the ATC tariff page.
New-build and certain commercial transactions may involve VAT and AJD instead of ITP; see the ATC property transaction guide. The tax base may also depend on the reference value under article 10 of the ITP law.
Ownership, income and sale
A non-resident may have IRNR obligations for rent, own use or an empty property, normally through Modelo 210. When a non-resident sells Spanish property, the buyer withholds 3% of the agreed price and pays it through Modelo 211, as explained by the AEAT. This is a payment on account, not necessarily the final tax.
| Area | Minimum check |

General information, not individual advice. A lawyer and tax adviser should confirm the structure against the investor and property documents.
Frequently asked questions
Does buying property grant residence in Spain?
Not by itself. The property route for new investment-residence applications was repealed; immigration status must be checked separately.
Is ITP always payable?
No. Depending on the asset and transaction, ITP or VAT and AJD may apply.
What is the 3% non-resident sale withholding?
The buyer pays 3% of the price on account of the non-resident seller’s tax. It is not necessarily the final liability.
