Rental deposit at Incasòl: deadlines, 2026 papers, cost of delay
Two months from signing, one month's rent for a home letting and a surcharge of up to 25% for delay. Which documents Incasòl asks for from 2026 and what RDL 29/2026 changed.
In Catalonia the landlord must lodge the tenant's deposit (fianza) with Incasòl within two months of signing the contract (Incasòl). For a main-residence letting it is one month's rent (art. 36.1 LAU, the Ley de Arrendamientos Urbanos). For delay without a demand from the inspectorate, a surcharge of 5% to 20% of the deposit applies, and after a demand, 25% (Llei 13/1996, art. 12 bis).
The fianza is the tenant's mandatory cash security. In Catalonia it is held not by the landlord but in the Registre de Fiances at Incasòl (Institut Català del Sòl, the Catalan land institute), and the landlord claims it back from there when the contract ends.
Who pays in, when and how much
The landlord pays in, personally or through a representative, within two months of the date the contract is signed, not the move-in date (art. 3.1 Llei 13/1996). The obligation remains when letting by the room. Updating and cancelling the deposit are handled within the same two months from the event that triggers them (art. 3.3).
| Contract type | Deposit amount per the Incasòl page | Basis |
|---|---|---|
| Main-residence letting | One month's rent | Art. 36.1 LAU |
| Premises for a use other than housing | Two months' rent | Art. 36.1 LAU |
| Seasonal letting of less than a year | Proportional to the term, where two months' rent corresponds to a year | Art. 3.2 Llei 13/1996, Decret 147/1997 |
An additional guarantee on top of the deposit is not lodged with Incasòl: Catalan law speaks of a cash deposit under art. 36.1 LAU. From 8 October 2026, Real Decreto-ley 29/2026 brings temporary letting within residential letting (art. 2.3 LAU), and what deposit is now required for a temporary contract the decree does not expressly settle. This question is checked with an abogado (lawyer) before signing.
What documents are needed from 2026
Incasòl expanded the document package in 2026. Before filing, prepare:
- The signed rental contract with all clauses and annexes.
- For main-residence contracts signed from 26 March 2026, the report of the state rental price index system (SERPAVI), attached to the contract.
- For temporary contracts signed from 1 January 2026, a document confirming the purpose of the temporary stay.
- The referencia catastral (cadastral reference), from the IBI receipt or the Catastro website.
- A nota simple (land registry extract) no more than three months old, if the owner has changed and the new one has taken over the contract.
- A translation of the contract into Catalan or Spanish, if it is drawn up in another language.
How to file: online or in person
Online filing is done with a digital ID through the Incasòl portal; for companies and other persons required to deal with the administration electronically it is the only way. If a representative files, the representative uses their digital signature.
Individuals can file in person: at the Cambres de la Propietat Urbana (urban property chambers) paying in cash, at the Generalitat's OAC offices or at Incasòl itself, where cards from private individuals and bank cheques are accepted. Online payment can be made through CaixaBank, Banc Sabadell and BBVA or by card. After payment the contract is entered in the register in about 15 days, and the registration number arrives by post or email.
What delay costs: a worked example
Worked example, not a forecast. Rent of 1,500 € a month, deposit of 1,500 €. The surcharges under art. 12 bis Llei 13/1996 are calculated on the deposit amount and together cannot exceed 1,500 €.
| Delay in lodging | Without an inspectorate demand | After an inspectorate demand |
|---|---|---|
| Up to 3 months | 5%, 75 € | 25%, 375 € |
| Up to 6 months | 10%, 150 € | 25%, 375 € |
| Up to 12 months | 15%, 225 € | 25%, 375 € |
| More than 12 months | 20%, 300 € and interest | 25%, 375 € and interest |
If the deposit is not lodged at all, that is a serious infringement with a fine of 35% to 75% of the deposit, in the example 525–1,125 € (art. 8–9). A late deposit without voluntary payment of the surcharge counts as a minor infringement with a fine of up to 35% of the deposit, but no more than 3,000 €.
What RDL 29/2026 changed for the deposit and guarantees
From 8 October 2026 Real Decreto-ley 29/2026 applies; Congress has not yet validated it (as of 13 October 2026), so before signing check the version in force with an abogado. Changes in art. 36 of the LAU:
- an additional guarantee on top of the deposit is no more than two months' rent in a contract of up to five years (seven if the landlord is a company) and no more than one in a temporary contract (art. 36.5);
- the tenant cannot be required to take non-payment insurance (art. 36.5);
- at the end of the contract the parties sign a document on the condition of the flat, and without it the flat is deemed handed back in good order (art. 36.7).
The refund rule did not change: any part of the deposit not returned a month after the keys are handed back earns statutory interest for the tenant (art. 36.4). All clauses on the deposit and guarantees are set down in the contract; the list is in the article what to include in a rental contract.
When one deposit is not enough
The deposit at Incasòl does not protect the landlord against non-payment: a one-month deposit covers the debt only in part, and the course of action on non-payment is covered in the article if the tenant does not pay. The scheme of "the deposit as part of income" does not work: the money sits at Incasòl until the end of the contract, and it is not counted in the yield calculation.
A non-resident landlord without a digital signature will need a representative, and with several flats each contract is lodged separately and within its own deadline. If a flat is still being chosen for letting, the letting format and the guarantees tied to it are worth building into the calculation in advance; the options are covered in the article furnished or unfurnished, and the calculation itself within an investment analysis.
Questions and answers
By when must the rental deposit be lodged with Incasòl?
Within two months of the date the contract is signed, not the date the tenant moves in. The same deadline applies to updating and cancelling the deposit.
How much is the deposit for renting a flat in Catalonia?
For a main-residence letting, one month's rent; for other premises, two. For a seasonal letting of less than a year Incasòl calculates in proportion to the term, and how this fits with RDL 29/2026 is clarified with an abogado.
What is the penalty for not lodging the fianza with Incasòl?
If lodged late before the inspectorate asks, a surcharge of 5–20% of the deposit. After the request, 25%. Not lodging the deposit at all is punished by a fine of 35% to 75% of its amount.
Can the deposit be lodged online from abroad?
Yes, with a digital ID through the Incasòl portal. Without one, a representative files, signing with their own digital signature on the owner's behalf.
