A separate permission and process

Renovation requiring scaffolding, a skip on the street or any other occupation of public space needs a separate municipal ocupación de vía pública permit. This is an independent procedure, rather than part of the building works licence (llicència d'obres). An approved works licence does not automatically authorise scaffolding or a skip on the street: the two approvals must run in parallel. This requirement is overlooked more often than might be expected, especially by contractors accustomed to jurisdictions with less stringent public-space controls.

How the permit works in practice

An ocupación de vía pública permit is generally time-limited and tied to the specific area occupied and duration of works. If works take longer than initially declared, an extension is possible, but requires a separate, planned request rather than happening automatically. In practice, this permit belongs in the project's administrative programme alongside the works licence. Treating it as a last-minute formality is risky: the municipality processes these applications at its own pace, independently of the principal licence.

Unauthorised occupation of public space is a separate offence, subject to penalties regardless of the main works licence's status. Even fully lawful building works offer no protection against liability for scaffolding or a skip placed without the separate street permit.

What to include in the programme

For an investor planning refurbishment, this is a distinct administrative step with its own processing time and delay risk. Manage it in parallel with the principal works licence rather than as paperwork that can be completed afterwards.

Practical recommendations:

• Apply for ocupación de vía pública while arranging the main works licence, rather than after receiving it.
• Allow for a permit extension if the actual programme exceeds the original plan.
• Assess the space genuinely required for scaffolding or a skip in advance so the permit matches site needs rather than the smallest declared footprint.

Why the historic centre is more difficult

On narrow streets in Barcelona's historic centre, public-space allocation requires closer scrutiny.
