How Project Duration Affects Taxes and the Overall Result
Capital gains tax in Spain barely depends on how long you hold, but a project's annual return depends on it heavily. Which taxes are tied to time, and how to calculate it before buying.
Project duration barely changes capital gains tax: for a resident individual, a non-resident and a company the rate is the same after one year or five. Time changes other things: annual payments (IBI, imputed income tax, upkeep), the annual return, the size of plusvalía municipal and the IVA regime on sale. So duration belongs in the project calculation before purchase, and is not a place to look for a tax saving. The information is current as of 12 October 2026.
Which taxes depend on duration
| Tax | Depends on duration | How | Legal basis |
|---|---|---|---|
| Capital gains tax, IRPF and IRNR | No | One rate regardless of duration; reduction coefficients exist only for property bought before 31.12.1994 | art. 46 LIRPF, disposición transitoria 9 |
| SL corporate income tax | No | One rate; the 15% rate applies to a new company in its first period with a positive base and the next, but not to an entidad patrimonial (asset-holding company) or companies in a group | art. 29 LIS |
| Plusvalía municipal | Yes | The coefficient rises and falls by year of ownership; a part-year is counted by months | art. 107.4 TRLRHL |
| IVA on sale | Yes | If the developer used the property for two years or more, the sale does not count as a first transfer | art. 20.Uno.22 LIVA |
| IBI | Yes | Accrues on 1 January to the owner, with no split by month | art. 75 TRLRHL |
| Non-resident's imputed income | Yes | Calculated by the number of days of ownership; not charged on a building under construction; from 2027 RDL 29/2026 introduces a progressive scale | art. 85 LIRPF |
| Patrimonio (net wealth tax) | Yes | Wealth at 31 December is taken | art. 29 Ley 19/1991 |
The table shows that duration affects taxes in two ways. Some are tied to a date (IBI on 1 January, Patrimonio on 31 December): a project closed on 30 December or on 2 January pays differently. Others depend on length (plusvalía, imputed income).
How plusvalía municipal works by year
The maximum coefficients in the law do not grow in a straight line. For a period of two years the upper limit is 0.14, for four years 0.16, for seven 0.20 and for fifteen 0.09 (the table in art. 107.4, which applies until 30 November 2026). These are limits: the actual coefficients and rate are set by the city's ordenanza (local tax bylaw), and the ayuntamiento (city council) calculates the tax, not the law. So an "extra" year of ownership does not necessarily increase plusvalía. The calculation and the two methods are covered in the article on plusvalía municipal.
Some coefficients have changed. The change to the maximum coefficients provided by Real Decreto-ley 26/2026 was withdrawn by Congress's decision on 2 October 2026 (BOE-A-2026-20526). A few days later Real Decreto-ley 29/2026 (BOE-A-2026-20823) raised the limits again from 1 December 2026: for two years 0.16, for four 0.17, for seven 0.23 and for fifteen 0.11. As of 12 October Congress has not validated this act. If your deal falls at the end of 2026, ask the asesor fiscal (tax adviser) which table and which Barcelona ordenanza will apply on your date.
A worked calculation: one project, four durations
A worked example, not a forecast and not a DNPI project. An EU non-resident, a private individual. Investment of €516,000 (purchase €400,000, ITP €40,000, notary €6,000, renovation €70,000). Sale for €620,000, seller's costs €20,000. The gain is €84,000, and IRNR at 19% is €15,960 whatever the duration.
Upkeep per year: IBI €1,500, comunidad (owners' association) €1,800, imputed income tax €314 (cadastral value €150,000, rate 1.1%, tax 19%; assumptions; if the municipality's cadastre has not been revised in the last ten years, the rate is 2% and the tax €570). A total of €3,614 a year. The sale price in the calculation is the same for any duration, and that is the strongest assumption: in practice a long project changes it.
| Duration | Upkeep costs | Net result after tax | Average annual return on €516,000, compounded |
|---|---|---|---|
| 1 year | €3,614 | €64,426 | 12.5% |
| 2 years | €7,227 | €60,813 | 5.7% |
| 3 years | €10,840 | €57,200 | 3.6% |
| 4 years | €14,454 | €53,586 | 2.5% |
The tax on the gain is the same, but the annual return falls by more than half when the project slips from one year to two. The euro total declines slowly, while the return on invested capital declines fast. If the capital is borrowed, interest will amplify the effect.
What to do with this, and what not to
Build a margin of time into the project budget: a delay in a permit or in the works costs more than it looks from the tax side. Realistic permit times are covered in the article on licence timelines in Barcelona. From a tax standpoint a short and a long project are equal in rate, but not equal in liquidity and risk.
Fitting the duration to a rate is not advisable. The 15% rate for a new company, the two-year IVA threshold and closing a deal before 1 January all have narrow conditions, and moving a date for tax reasons can easily end in a dispute with Hacienda (the tax authority). Questions about dates are settled together with the asesor fiscal, not afterwards.
Who this calculation is not for
It does not suit a property bought before 1995, a sale of a share, or a structure that includes several companies. The calculation also ignores the taxes of your country of residence. Questions for the asesor fiscal: from what date does my period run, how does moving the closing across 1 January or 31 December affect me, and how to split IBI with the buyer in a mid-year deal. The effect of taxes on the overall picture is visible in the full project budget, and the answer to "does a long holding period reduce tax" is given in the article on the holding period and tax on sale.
Questions and answers
Is less tax paid if the property is held longer?
Capital gains tax for an individual and for a company does not fall with time. Only plusvalía municipal may decrease, if the coefficient for your year is lower, and only within the city's ordenanza.
Who pays IBI if I sold the apartment mid-year?
The tax accrues on 1 January to the owner on that date (art. 75 TRLRHL). The split between seller and buyer is usually fixed by the parties in the contract.
Is imputed income charged while the renovation is under way?
For a building under construction the law does not charge imputed income (art. 85 LIRPF). Whether your renovation counts as construction is decided by the facts of the property, and that is a question for the asesor fiscal.
Which costs more: a short project or a long one?
The tax on the gain is the same, while annual costs and the cost of capital grow with every month. The example above shows how the difference in return arises without any change in tax.
