Can a large plot be split? Parcelación and segregación
A plot can be split into two lots if the plan allows it and the minimum area is met. What parcelación urbanística is, where it is banned, and how a lot reaches the land registry.
A plot in Catalonia can be split into two lots only if the new lots comply with the plan and the operation has obtained a licencia de parcelación (subdivision licence) or a ruling that no licence is needed. In suelo no urbanizable (non-developable land) a plot cannot be split for building under any circumstances. Parcelación urbanística is any division of land into two or more lots that makes building for urban use easier (art. 191 TRLU, the Catalan urban planning law). Below are the order of checks, examples for a 2 000 m² plot and the situations where splitting is not possible. What is allowed in Pedralbes, Sitges or Alella is set by their plans, and there is no single minimum-area figure for all three.
How does parcelación differ from segregación?
Segregación is a land-registry operation: part of a finca (registered property) is separated off. Parcelación urbanística is the legal classification of that operation when it is aimed at building. If it is, a licencia de parcelación is required. If not, the ayuntamiento (town hall) declares the licence unnecessary, and that too is a document without which you cannot reach the registry (arts. 192, 193 TRLU).
The notary and the registrar check this themselves. The land law says that when attesting deeds of division the notary requires the document of administrative consent, and the registrar requires it for inscripción (registration) (art. 26.2 TRLSRU). A division "on paper" without a licence will not pass.
The law also covers indirect schemes. Selling or letting undivided shares with the right of exclusive use of part of the plot, and holding an interest in a company that confers such a right, also count as parcelación (art. 191.1.b and 191.1.c). For an investor this is an important point: if a project is split between buyers through an SL (limited company) or shares, that too can be parcelación.
When can a plot not be split?
The law lists the cases in which a plot is indivisible.
| Situation | What the law says |
|---|---|
| Suelo no urbanizable | Parcelación urbanística is banned in all cases (arts. 47.2 and 195.1) |
| Plot not larger than the minimum area under the plan | Indivisible, except transfer of lots to adjoining owners for merger (art. 196.1.b) |
| Plot smaller than twice the minimum area | Indivisible if the excess cannot be transferred to a neighbour (art. 196.1.c) |
| Plot built on a share of volume | The remainder, if smaller than the minimum parcela, is indivisible (art. 196.1.d) |
| Land outside towns smaller than twice the minimum cultivation units | Indivisible (art. 196.1.e) |
In addition, parcelación in urban and urbanizable land is possible only after the general plan (POUM or plan de mejora urbana) or the plan parcial has been approved (art. 195.1). Lots created in breach are never treated as solares (buildable urban plots), and building on them is not allowed (art. 195.2).
What is the order of the division procedure?
- Request a certificate of the plot's planning regime and of the minimum parcela for its zone. For Sitges the basis is the POUM; for Barcelona and Alella ask the ayuntamiento.
- Get a nota simple and check that the finca is free of charges and how the area is recorded.
- File the application for a licencia de parcelación or a declaración de innecesariedad (declaration that no licence is needed).
- After the decision, sign the escritura (notarial deed): it records the indivisibility where it arises (art. 196.2).
- Register the new fincas. Only then can a licencia de obras (building licence) be requested for each lot.
The timeline depends on the ayuntamiento. Licence timelines are covered in more detail in a separate article.
How is a 2 000 m² plot split in practice?
Worked example, not a forecast and not the parameters of Pedralbes, Sitges or Alella. The minimum areas are assumed: I did not check the real values for those zones.
| Plan assumption | Minimum per lot | Result for 2 000 m² |
|---|---|---|
| Minimum 800 m² | 800 m² | 2 000 ≥ 1 600, splits into two lots of 1 000 m² |
| Minimum 1 100 m² | 1 100 m² | 2 000 < 2 200, indivisible unless the excess goes to a neighbour |
| Minimum 1 000 m² | 1 000 m² | 2 000 = 2 × 1 000, not less than twice the minimum, splits exactly in half |
The last row is a borderline case: the rule in art. 196.1.c speaks of plots "smaller than twice the minimum", and the answer has to be checked against the text of the plan and against measurements. A 20–30 m² discrepancy between the cadastre and reality can change the answer, which is why a topographic survey is needed before the deal, not after.
What happens if you split without a licence?
The lots will not become solares, and building on them is not allowed (art. 195.2). The breach is classed as an infracción urbanística (planning offence): division in protected land outside towns is very serious (art. 213.d), in ordinary land outside towns and in non-delimited urbanizable land it is serious (art. 214.f). In urban land, breach of the indivisibility regime is minor (art. 215.a), and division contrary to planning rules is serious (art. 214.b). A division without a declaration of non-necessity is treated as legalised if such a declaration was requested and obtained (art. 216.3). If it is parcelación urbanística, a licence is required, and legalisation is decided by the ayuntamiento.
Who is plot splitting not suited for?
Anyone who buys a large plot expecting to sell two halves later but has not checked the plan and the minimum area. Land outside towns is almost always closed. A timeline of less than a few months does not work either: the licence, escritura and registration run in sequence. Nor do schemes where lots are "divided" through SL shares or undivided shares: that too is parcelación, and the abogado (lawyer) classifies it.
If you are assessing a plot as a project, start with land classification and the planning assessment: plot checks, buildability and the general land page.
Questions and answers
Is a licence needed to split a plot?
Any division goes through prior control by the ayuntamiento. If it is parcelación urbanística, a licencia de parcelación is required; otherwise the ayuntamiento issues a ruling that no licence is needed. Without one of the two documents the notary and the registrar will not complete the transaction.
Can a plot be split in suelo no urbanizable?
Parcelación urbanística is banned there (art. 47.2). A division with no building purpose goes through a declaración de innecesariedad, subject to sector rules, including minimum cultivation units (arts. 192.2 and 196.1.e), and that question is settled by the abogado together with the ayuntamiento.
What does an "indivisible plot" mean?
A plot that the law or the plan does not allow to be divided: it is no larger than the minimum area or smaller than twice the minimum. Indivisibility is recorded in the escritura and in the registry.
Does selling SL shares with a right to part of the plot count as a division?
The law treats the sale of shares and holding an interest in a company as parcelación when they confer an exclusive right to part of the land. A question about a specific scheme goes to the abogado before the deal.
How long does splitting a plot take?
I found no general open figure: the timeline depends on the ayuntamiento and on how complete the documents are. Allow for the sequence licence, escritura, registration, and ask the municipality itself for the timeline.
