A flat in Barcelona from abroad: stages, roles and the owner's costs
A remote purchase rests on three things: who views the property for the buyer, how the money moves and what is paid as a non-resident owner. Stages, roles and a worked calculation.
Buying a flat in Barcelona while living abroad is possible with a single trip: the NIE (foreigner's identity number) is arranged through a Spanish consulate (in Paris, for example, in two weeks on average, consulate information), and the escritura (notarial deed) is signed on the buyer's behalf by a representative under a notarial power of attorney. The main risk is not legal. The buyer sees the flat through other people's eyes, and what matters is who they work for.
What it means to buy a flat remotely
A remote purchase is a transaction in which the buyer takes part personally only in the key decisions, while viewings, negotiation, checks and signing are handled by representatives. Legally it is an ordinary purchase. What differs is the distribution of roles.
A remote buyer usually has four helpers with different interests. The local agent: in Catalonia, whoever mediates regularly and for pay from an office open to the public is entered in the Registre d'agents immobiliaris (the Catalan register of estate agents), and the registration number can be checked. The abogado (lawyer) reviews the documents and writes the contract. A technical specialist inspects the building and the flat. The notary certifies the transaction and advises the parties impartially (art. 147 Reglamento Notarial), but does not act for the buyer's interests. How to check who the agent really works for is covered in the article on conflict of interest.
Which stages can be done remotely
Almost all of them, except one viewing of the final options. It is sensible to do that in person: evening noise, the light in the rooms and the route to school come across poorly on video.
| Stage | What the buyer decides | What the representative does | What to require in writing |
|---|---|---|---|
| Brief and budget | District, type, maximum price including taxes | Checks the brief against the market | A list of mandatory conditions |
| Viewings | Which options to see in person | Video and a report on each flat | Drawbacks and questions for the seller |
| Price and offer | Negotiation limit | Comparison with transactions, negotiation | Justification of the price |
| Checks before the arras | Sign or not | Nota simple (land-registry extract), community debts, ITE (building inspection), technical survey | A list of risks |
| Signing the escritura | Scope of the power of attorney | Signs under the poder notarial | Draft escritura in advance |
| After the purchase | Let or use | Keys, meters, refurbishment | A handover report |
How to get an NIE and a power of attorney without travelling
The NIE is applied for at the Spanish consulate where the applicant lives, in person or through a representative. Under the rules of the consulate in Paris, the presence of the applicant or their representative is mandatory, representation is possible only under a notarial power of attorney, and the grounds may be an arras contract (deposit contract) or a promise of sale. The fee there is 9.84 € for the first NIE. A consular NIE allows dealings with Spanish authorities but gives no right to reside in Spain. Other consulates have their own timelines and document lists.
A foreigner grants the power of attorney before a Spanish notary, at a Spanish consulate, or before a notary in their own country with an apostille (Consejo General del Notariado, the General Council of Notaries). Which powers to include is covered in the article on the poder notarial.
How not to lose money at a distance
An order in which money leaves only after checks:
- Do not transfer the deposit until the abogado has checked the nota simple, the debts and the building's documents.
- Pay only by bank transfer from account to account. In transactions with a business or professional, cash payments of 1,000 € or more are not allowed (Agencia Tributaria, the Spanish tax agency).
- Check the recipient's bank details by voice with the abogado, not from an email.
- If the seller is also a non-resident, the buyer withholds 3% of the price and pays it to the tax agency on account of the seller's tax (art. 25.2 TRLIRNR, the consolidated non-resident income tax law). This is settled before the arras.
- Ask for the draft escritura a few days before signing and read it with the abogado.
What tax the owner pays if they do not live in Spain
If the flat is not let and is not the owner's main home, a non-resident pays IRNR (non-resident income tax) every year on imputed income (renta imputada). It is calculated under art. 85 of the Ley del IRPF (personal income tax law), to which art. 24.5 TRLIRNR refers: under the current wording, 2% of the cadastral value, or 1.1% in municipalities where values were revised within the period set by law (LIRPF). The IRNR rate is 19% for residents of the EU and the EEA and 24% for everyone else (art. 25.1 TRLIRNR).
Worked example, not a forecast. Cadastral value of the flat 200,000 €, owner resident in the EU.
| Rule | Imputed income | IRNR 19% |
|---|---|---|
| 2% of cadastral value | 4,000 € | 760 € |
| 1.1% of cadastral value | 2,200 € | 418 € |
Since 8 October 2026 Real Decreto-ley 29/2026 (royal decree-law) has been in force (BOE): from 1 January 2027 it replaces art. 85 with a scale from 1.1% to 3% depending on the sum of cadastral values. The Congress of Deputies has not yet validated the decree-law, so before deciding, check the current wording and its application to non-residents with an asesor fiscal (tax adviser). The general picture of taxes is collected on the page taxes for a foreign investor.
When a remote purchase does not suit
It works badly if the city is unfamiliar and there is no time even for one trip: choosing a district from video is risky. It does not suit a buyer who is not ready to give a power of attorney with clear limits or cannot check whom their agent is paid by. For a house needing refurbishment or a property with tenants the remote format is also weak: decisions on site are taken more than once a month.
If the task is clear and a review of a specific property or district is needed, write through the contact form.
Questions and answers
Can a flat in Barcelona be bought without ever visiting?
Legally yes: an NIE through the consulate, signing under a power of attorney. In practice, at least one visit to see the final options lowers the risk of a mistake over the district and the flat.
How long does an NIE through a consulate take?
It depends on the consulate. In Paris, according to the consulate, two weeks on average, with a fee of 9.84 € for the first number; the timelines of other consulates are on their websites.
How can I check an agent in Barcelona if I am viewing flats from abroad?
An agent with an office in Catalonia is entered in the Registre d'agents immobiliaris, and the number appears on the sign, in the documents and in advertising. Then ask in writing who pays them.
What tax does a non-resident pay on an empty flat in Spain?
IRNR on imputed income: under the current wording 2% or 1.1% of the cadastral value, at 19% for residents of the EU and the EEA and 24% for everyone else. Real Decreto-ley 29/2026 changes the calculation from 2027, but the Congress of Deputies has not yet validated it.
Is a Spanish bank account needed to buy?
It depends on the payment scheme and on your bank. The question is usually settled in advance with the abogado so that the transfer for the escritura does not hold up the transaction.
