Buying a flat in Spain with crypto: the path to the escritura

The notariado treats bitcoin as property, not money, so exchanging it for a flat becomes a swap. How the deal works in practice: conversion, bank, source-of-funds documents and timing.

You can buy a flat in Spain with money from cryptocurrency, but the seller usually has to be paid in euros after conversion. The Consejo General del Notariado (the national notaries' council) states outright that bitcoin is not money but property, and handing it over for a flat means concluding not a sale but a permuta (exchange), in which tax is paid on both transfers (Notariado). That is why the deal is built through a bank and source-of-funds documents.

Why direct payment in crypto is almost never seen

A sale presupposes payment in money, and a cryptocurrency, by the notariado's explanation, is not money. Exchanging a flat for bitcoin is legally a different transaction, the permuta, in which each party receives property, and the overall tax burden is higher.

The second obstacle is in the paperwork. The Ley del Notariado requires that an escritura (notarial deed) for the paid transfer of real estate for money state the means of payment: when the price was received, in what amount, in cash, by cheque or by bank transfer (art. 24). A bank transfer from a Spanish or European bank meets this requirement simply, and a chain of wallets does not.

What the money's route looks like in practice

The cryptocurrency is first sold for euros, the euros arrive in the buyer's bank account, and from that account the deposit and the price are paid. The escritura shows euros and bank transfers, and the cryptocurrency stays in the history of where the funds came from.

The bank, notary, registrar, abogado and agency are obliged entities under the anti-money-laundering law (art. 2 Ley 10/2010) and each checks the buyer on its own. What exactly they will request and in what order is covered in detail in the article on AML when buying.

Which source-of-funds documents to prepare

The longer a crypto asset's history, the more questions the bank has, so the file is assembled in advance.

  1. Statements from exchanges and platforms for the whole period of holding: purchases, sales, transfers.
  2. Proof of where the money for the initial purchase of the cryptocurrency came from: salary, sale of a business, other assets.
  3. The link between wallets and the owner: which addresses belong to the buyer and how funds moved between them.
  4. Tax returns showing crypto transactions, if they were required in the country of residence.
  5. If one family member bought the crypto asset and another is buying the flat, documents on the transfer of funds between them.
  6. Proof of the transfer of euros to a Spanish account. What the package usually looks like when capital is transferred from abroad is described in the article on documents for transferring capital.

What about taxes on the crypto side

Selling cryptocurrency for euros is itself a taxable event, separate from buying the flat. For Spanish tax residents, the Agencia Tributaria describes it as a capital gain or loss equal to the difference between the sale price and the acquisition price (AEAT).

Residents also have a reporting duty: modelo 721 is filed if cryptocurrency held with foreign providers on 31 December is worth more than 50,000 € in total (AEAT, modelo 721). For non-residents the rules are set by the country of residence. How this combines with the declaration of foreign assets is described in the article on modelo 720, and the specific case is calculated by an asesor fiscal (tax adviser).

How not to break the deal's timeline

The seller, when signing the arras, counts on an ordinary payment schedule. If the buyer's plan includes selling crypto and an extra check by the bank, this is said in negotiations, before signing, and a time reserve is built in before the date at the notary.

A practical rule: the euros must be in the buyer's account and have passed the bank's check before the arras are signed. Then the cryptocurrency's price in the period between the deposit and the escritura no longer affects the deal.

When this route does not suit

The scheme does not work if the buyer cannot show the origin of the crypto assets with documents: obliged entities do not carry out the transaction if they cannot apply due diligence measures (art. 7.3 Ley 10/2010), and the deposit will be at risk. Nor does it suit someone who wants to hold the cryptocurrency until the last day before the deal: a drop in price between the arras and the escritura may leave the buyer without the needed sum.

A direct exchange of a flat for cryptocurrency, that is, a permuta, is theoretically possible, but its tax consequences for both parties are assessed by an asesor fiscal, and most sellers do not agree to it. The general tax context for a foreign buyer is collected on the page on foreign investor taxes.

Questions and answers

Can I buy a flat in Spain with bitcoin?

You can receive a flat in exchange for bitcoin, but by the notariado's explanation it will be an exchange, not a sale, with tax on both transfers. In practice the cryptocurrency is sold for euros and payment is made by transfer.

Will the notary check the origin of money from cryptocurrency?

Yes. The notary records the means of payment in the escritura and is an obliged entity under the anti-money-laundering law, like the bank. The history of crypto transactions is needed for both.

Do I have to pay tax when selling cryptocurrency to buy a flat?

For Spanish tax residents, selling cryptocurrency for euros produces a capital gain or loss on the price difference. Non-residents check their own country's rules with an asesor fiscal.

What is modelo 721?

A reporting declaration for Spanish tax residents on cryptocurrency held with foreign providers. It is not filed if the total value on 31 December does not exceed 50,000 €.

Do banks take cryptocurrency into account for a mortgage?

There is no single rule; the specific bank decides. The answer on whether it will accept funds from the sale of crypto assets as the buyer's own contribution is obtained in writing before the arras are signed.
