Tourist Tax and Hotel Regulation in Catalonia
The guest pays the tourist tax, and the hotel collects and files it. Rates rose from 1 April 2026, and Barcelona's surcharge will rise for two more years in a row.
Catalonia's tourist tax (impost sobre les estades en establiments turístics, IEET) is paid by the guest, while the hotel puts it on the bill and files a return twice a year. Since 1 April 2026, in Barcelona a 4* hotel collects 3.40 € of tax plus a 5.00 € municipal surcharge per person per night, and a 5* hotel collects 7.00 € plus 5.00 €. For a hotel owner the tax is not income but a duty to collect and report.
Which rates apply now
The rates were changed by Llei 2/2026 of 6 March, published in the DOGC on 10 March 2026, and they apply from 1 April 2026. According to the Agència Tributària de Catalunya, for the period from 1 April 2026 to 31 March 2027, per person per night:
| Type of accommodation | Barcelona: tax | Barcelona: surcharge | Total in Barcelona | Rest of Catalonia |
|---|---|---|---|---|
| 5* hotel, gran lujo | 7.00 € | 5.00 € | 12.00 € | 4.50 € |
| 4* and 4* superior hotel | 3.40 € | 5.00 € | 8.40 € | 1.80 € |
| Other hotels and accommodation (EB3) | 2.00 € | 5.00 € | 7.00 € | 0.90 € |
| Habitatge d'ús turístic (tourist housing) | 4.50 € | 5.00 € | 9.50 € | 1.75 € |
Barcelona's surcharge under ordenança fiscal 2.2 is rising: 6.00 € from 1 April 2027 and 7.00 € from 1 April 2028. In the rest of Catalonia the rates also go up from 1 April 2027 (for a 5* hotel to 6.00 €, for 4* to 2.40 €). Barcelona's base rates for the periods after March 2027 had not been published by the ATC at the time of checking.
Who pays and who files the return
The tax is paid by guests, and the payment goes through the hotel: the hotel includes it in the accommodation bill. The holder of the establishment files the return and pays the money, on forms 950, 940 or 920, in two windows: 1 to 20 October for the April-September period and 1 to 20 April for the October-March period. The tax is charged for a maximum of 7 consecutive nights in one establishment. Exempt are children under 17, stays for health reasons, stays under social programmes of an EU administration and cases of force majeure.
The conclusion for an owner: the tax does not enter the hotel's revenue, but the return and the responsibility for correct collection rest with the establishment. These duties are worth fixing in the contract with the operator: who collects, who files, who answers for a mistake. On the terms of such contracts, see the article on lease and management.
What this means for the room price
A worked example, not a forecast. A guest paying Barcelona's average rate of 177.4 € per room per night (Colliers, 2025) adds 2 × 8.40 = 16.80 € for two people in a 4* hotel, about 9.5% of the rate. In a 5* hotel the addition is 24 €, about 13.5%. A couple for three nights in a 4* hotel pays 50.40 € of tax. How guests react to a higher surcharge depends on the market, and I found no reliable demand-elasticity figure in open sources.
How the tax fits with the rest of hotel regulation
The tax is only one of three planes of regulation. The other two determine whether a hotel can operate at all.
- Catalan tourism law. The tourism law 13/2002, decree 75/2020 and Decret 159/2012 set the types of establishment, the categories and the procedure of declaración responsable (a sworn declaration) with an entry in the Registre de Turisme de Catalunya. The types are broken down in the article on hotel, aparthotel and hostel.
- Barcelona's planning scheme (PEUAT). It determines where new hotels are allowed and restricts new hotels in the centre. More in the article on PEUAT zones.
- Taxes. The IEET and the surcharge discussed above. Standing apart are the restrictions on tourist apartments, which concern a different segment: they are described in the article on licences until 2028.
What to check before buying or leasing a hotel
- How the operator collects and files the tax now, and whether the ATC has raised any claims.
- Whether the tax is mixed into revenue in the operator's report. How such a report is built is shown in the article on the operator's report.
- Which tax rates are in the budget for next year: the surcharge rises twice.
- How the tax is shown in prices on the website and in the OTAs.
These are questions for an asesor fiscal and the operator, not conclusions from this article.
Who this article does not suit
To assess the tax for a specific night, or a property where special rates apply (gambling centres), you need the full ATC table: it has separate rates TE1–TE3. For a resort hotel outside Barcelona the rates are different; see the piece on hotels on the Catalan coast. DNPI's general view of hotel projects: the page on hotels.
