Flipping in Spain remotely: what can be delegated and what cannot

Remote flipping is a question of authority rather than technology: what the representative signs, who decides on site and which decisions stay with the investor.

Flipping in Spain without being present is technically possible, and most of the actions can be delegated. Remote participation is an arrangement in which the transaction and the works are run by a representative or an operator under contract, while the investor keeps the decisions about money and about price. The minimum needed before a first transaction is a NIE, a Spanish bank account and a notarial power of attorney. The requirements for a representative when obtaining a NIE are set by the consulates: the consulate in Stuttgart, for example, accepts an application from a representative only under a notarial power of attorney and with an apostilled copy of the principal's passport (consulate guidance).

What has to be in place before the first transaction

  1. NIE. The foreigner's identification number, without which you can neither buy nor sell nor pay taxes. The procedure is covered in the article on the NIE for a foreign buyer.
  2. A bank account in Spain. Needed for transaction payments, taxes and holding costs (an account for a foreign investor, an account for an S.L.).
  3. A notarial power of attorney. Its scope decides what the representative can sign without you (power of attorney for a remote purchase, power of attorney and an S.L. structure).
  4. Proof of the source of funds. A transfer of capital comes with documents (transferring capital to Spain, transparency and AML).

There is a hard restriction on settlement: according to the Agencia Tributaria, payments in cash of 1,000 € or more are not allowed where one of the parties acts as a business or a professional. Separately, from 2027 the single EU anti-money-laundering regulation 2024/1624 starts to apply (per the European Commission page), so documentary requirements on the source of funds are more likely to tighten than to ease.

What can be delegated and what stays with the investor

A simple rule: execution is delegated, decisions about money are not. Once a representative gains the right to change the price or the budget, the point of control disappears (management decisions and investor rights).

Who makes decisions on site

On a building site decisions are needed faster than correspondence moves: the strip-out exposes services, the contractor hits a dimension, a material goes out of production. That is why a project has technical supervision, works direction and a contractor, each with its own set of decisions (technical supervision, direcció d'obra). Works on DNPI projects are carried out by BCNYARD, SLU: an independent construction company engaged under contract.

The boundary runs along the money. A decision inside the approved budget is taken by the works direction; a decision that moves the budget or the term goes to the investor. This requires a payment schedule and control of the estimate by chapter, otherwise an overrun only becomes visible at the end (payment schedule and estimate control, renovation budget control).

How an investor controls a project at a distance

Control at a distance is built on documents, not on visits. What is requested regularly: budget against actual by chapter, permit status, photo reports by stage, sign-offs, statements from the project account. A DNPI investor has a digital account for this, with the budget and the status of the works (reporting to the investor).

Documents can also be checked independently. A nota simple, in the registrars' own words, is "puramente informativa", purely informative, while a certificación is signed by the registrar and carries fe, legal force. If the property belongs to a company, its annual accounts can be requested: a limited liability company is required to file them with the Registro Mercantil within one month of their approval (art. 279 Ley de Sociedades de Capital). What is better done in person is covered in the article on power of attorney and a personal visit.

What a delayed decision costs: a worked example

A worked example, not a forecast. These are assumptions, not project data: holding costs of 800 € per month, the works stop while a change is approved, one decision on a material takes three weeks to agree instead of three days.

EventIdle timeDirect costs
Decision on a material agreed in 3 daysnone0 €
Decision waits 3 weeksabout 0.7 monthsabout 560 €
Three such decisions in a projectabout 2.1 monthsabout 1,700 €

The sums themselves are small, and that is not the point: idle time shifts the selling window. If the sale moves across a season, what changes is not the holding cost but the exit price, and that effect is an order of magnitude more expensive. So in a remote project the investor's response time and the limits within which decisions are taken without them are agreed in advance.

Who the remote format does not suit

Anyone who wants to approve every line of the cost estimate personally: the speed of decisions on site does not allow it, and the project will stand still. Anyone unwilling to grant a power of attorney: without one, every signature requires a trip to a notary in Spain. Anyone counting on remote control without documents: a budget cannot be checked from photographs. And anyone selling as a non-resident without having worked out the withholding regime and the filings in advance (the 3% withholding on a sale, a non-resident seller and IRNR).

The way into a project without a trip is described on the investor roadmap page, and the tax framework for a non-resident is collected on the foreign investor taxes page.

Questions and answers

Can an apartment in Barcelona be bought without coming to Spain?

Yes, if you have a NIE, an account and a notarial power of attorney of sufficient scope. The signing before the notary is then done by the representative, and the terms of the deal are agreed in advance.

What cannot be delegated in flipping?

Decisions that move the project's money: the maximum entry price, approval of the budget and the reserve, changes above budget, the exit price and agreement to a deal. Everything else is execution.

Is at least one trip necessary?

Legally no, if the power of attorney covers the required actions. In practice many investors come at the property selection stage, to match photographs against the real neighbourhood and building.

How do you know the renovation is on budget from abroad?

By comparing budget with actual by chapter, by the sign-offs and by statements from the project account. A photo report shows how the works are going but not how the money is spent, and a budget cannot be checked from a photograph alone.

How does an investor participate in a DNPI project in the remote format?

DNPI's fee is 50% of project profit; the other half stays with the investor. If the investor return for the whole project after the split is below the contractual 10%, DNPI pays compensation out of its own fee. This is a return for the project, not an annual rate; the terms, the calculation base and the limits are set by the contract for the specific project, and this is not a guarantee that capital will be preserved.
