Investment approach

Can You Invest in Barcelona Real Estate Without Living in Spain?

You can invest in Barcelona remotely: the NIE is obtained through a consulate, a representative signs the deal under a poder notarial, and you follow the works through reports.

Yes, you can. You obtain the NIE (foreigner's tax identification number) through a consulate, the money goes by bank transfer, and the deal is signed by you or by a representative under a poder notarial (a notarial power of attorney). The property, the renovation and the sale can be managed from a distance if you have a lawyer, independent checks and regular reporting. Two things cannot be switched off: non-resident taxes and the notary's questions about where the money comes from.

What can be done remotely, and what needs you present?

StepRemotelyHow it is done
NIEyesapplication on form EX-15, filed at the Spanish consulate where you live, in person or through a representative
Property checksyesregistry extract, technical report, documents arrive digitally
Money transferyesbank transfer, with proof of the source of funds
Signing the escritura (the deed of sale)yes, through a representativea poder notarial is needed
Acceptance of workspartlya report and photos, plus an independent technical specialist
Tax returnsyesthrough an asesor fiscal (tax adviser) in Spain

The procedure is set by art. 205 of the Reglamento de extranjería (RD 1155/2024) (the immigration regulation): a foreigner who has economic, professional or social ties to Spain asks for an NIE to be assigned and states the reason, and if abroad, applies through a Spanish consulate. In practice this is form EX-15. The law does not specify requirements for the representative; they are set by the consulates. For example, the consulate in Stuttgart accepts an application from a representative only with a notarised power of attorney and an apostilled copy of the principal's passport (consulate guidance). Deadlines, the list of documents and the filing procedure differ between consulates, so check them with your own and allow weeks.

How does a poder notarial work?

A poder notarial is a notarial power of attorney under which a representative (apoderado) signs documents on your behalf. For a purchase, a poder especial is usually issued: it names the transaction, the property, the maximum price and the actions the representative may take.

If you sign the power of attorney abroad, it is usually executed before a local notary, given an apostille under the Hague Convention, and translated by a sworn translator if the document is not in Spanish. This is the general procedure: agree the form and content of the power of attorney with an abogado (lawyer) before you visit the notary, because a Spanish notary may require changes. Translation questions are covered in the article on sworn translation.

A power of attorney gives another person the right to sign for you. Limit it to the property and the price, choose a representative who has no link to the seller, and keep the right to revoke the authority before signing.

How do you control the project when you are not there?

Control is built on documents, not on presence. You need three things: a budget showing plan against actual, a status of works with dates, and independent checks. In DNPI projects the investor gets a digital account with the budget and the status of the works, and the renovation is carried out by BCNYARD, SLU, an independent construction company working as a contractor under a contract. The contractor's independence matters precisely for a remote investor: you cannot walk onto the site, so you need someone who checks the work against the contract.

What is better not done remotely

  • Never seeing the property. The law does not forbid it, but photos and a report do not replace a feel for the building and the neighbourhood. A comparison of approaches: buying by power of attorney versus travelling in person.
  • Signing from a template the seller sent you. The power of attorney and the contract are read by your abogado.
  • Putting off the question of the source of funds. Under the anti-money-laundering law (Ley 10/2010), a notary in Spain identifies clients and ultimate beneficial owners, so prepare the documents in advance. See source of funds for a property purchase.

Non-resident taxes

A non-resident who owns property in Spain usually files a separate return, and living abroad does not exempt you from it. Whether it is needed in your case, which one and when is for an asesor fiscal to determine; there are rules for housing that is not rented out, too. More in the article on Modelo 210. Separately: if you sell as a non-resident, your buyer withholds 3% of the price and pays it to the tax authority (Modelo 211) on account of your tax (AEAT).

Who the remote format does not suit

Someone who is not ready to read documents in English or Russian and translations from Spanish. Someone who has no time to answer a lawyer within a day or two: unanswered instructions block the deal. And someone who wants to pick the finishes and the contractor personally: that is possible, but then it is easier to travel.

Questions and answers

Do I need a Spanish bank account to buy property remotely?

Whether you need to open one depends on the payment scheme and your bank: that is a question for an abogado. In any case the transfer goes through the banking system, and the notary may ask for the source of funds.

Can I get an NIE without coming to Spain?

Yes, the application is filed at the Spanish consulate where you live. Check the list of documents and the deadlines with the specific consulate.

How much does a power of attorney cost?

The notary and the translator name the price: it depends on the length of the document and on tariffs. Put a separate line in the budget and ask for the exact sum in advance.

What if the representative under the power of attorney does not carry out the instruction?

Revoking a power of attorney is done by a separate notarial document; ask your abogado about the procedure. Limit the authority to the property and the price in advance.
