Medium-Term Rentals in Barcelona: Rules and Risks
From 1 January 2026 a seasonal lease in Catalonia needs a documented temporary reason, otherwise it is treated as a permanent-residence lease with a rent cap and a minimum term.
From 1 January 2026 a medium-term rental in Barcelona does not take a flat out of the housing-lease regime if the contract serves a housing need. Under Catalonia's Ley 11/2025 the temporary reason (work, study, medical treatment and the like) must be stated in the contract and backed by documents, and without that proof the contract is treated as a permanent-residence lease. The law is being challenged in the Constitutional Court but remains in force. Since 8.10.2026 the national Real Decreto-ley 29/2026 has been added to it, and it also introduces a "temporary housing lease".
What counts as a medium-term rental
Until October 2026 art. 3.2 LAU classed a lease "por temporada" (seasonal) as a lease for a use other than housing, where the parties have more freedom on terms. Catalonia narrowed that freedom with its own law. The new art. 66 bis of Ley 18/2007 on the right to housing, added by Ley 11/2025 of 29 December 2025, came into force the day after publication in the DOGC, that is, on 1 January 2026. It divides contracts into three groups.
| Type of contract | Regime |
|---|---|
| Any lease that meets a housing need, whatever its term | Permanent-residence lease under the LAU |
| Temporary for a reason: work, study, medical care, waiting for housing to be delivered, return to the main home and similar | Housing-lease rules on fianza (security deposit), guarantees, setting and updating rent, increases for improvements, expenses and services |
| Leisure, holiday or tourism only | Rules for leases for a use other than housing; the purpose and the tenant's permanent residence are stated |
Tourist rentals are not affected by this regime. If a contract names a term but does not state the purpose of the temporary nature, the housing-lease rules apply to it as well (art. 66 bis.2).
What Ley 11/2025 requires of the owner
The law puts the burden of proof on the landlord. The order of steps follows from art. 66 bis:
- The reason for the temporary nature and the tenant's place of permanent residence are written into the contract.
- Supporting documents are attached and deposited with the fianza in the registre (fianza register).
- If the register holds no proof of another use, the contract is presumed by law to be a permanent-residence lease.
- On renewal without a proven reason, the permanent-residence rules apply to the contract, including the minimum term and extensions, counted from the date of the original contract.
- A new contract with the same tenant for the same flat falls under the permanent-residence rules unless the landlord proves the reason for the temporary nature persists.
The housing rules on setting and updating rent, which art. 66 bis.2 extends to temporary contracts, mean a rent cap in a stressed-market zone, as for permanent contracts (analysis of the rent ceiling). Barcelona was in such a zone under the 2024 declaration. According to 3Cat of 28.07.2026, the Generalitat extended the first declaration by a year and adopted a new one: the number of municipalities rose to 302 from 271, but after publication in the DOGC a period of alegaciones (objections) follows, and the final list is approved by the Ministerio de Vivienda. A flat's status on the date of the contract is checked against the current resolution. For rooms the law added a separate rule, covered in the article on renting by the room.
What changed at national level
Real Decreto-ley 26/2026 of 29 September 2026 amended the LAU, including art. 3.2, but on 2 October 2026 Congress decided to repeal it (BOE No. 245). Four days later Real Decreto-ley 29/2026 of 6 October was issued, and according to the consolidated text of the LAU on the BOE it has been in force since 8.10.2026. Congress has not yet validated it, so the rules below cannot be treated as settled:
- art. 3.2 LAU no longer calls a lease "por temporada" a non-housing lease, and the new art. 2.3 and 7.2 introduce an "arrendamiento de vivienda temporal" (temporary housing lease) for a person who has temporarily left their main home for a provable reason;
- under art. 9 bis the term of such a contract is more than 31 days and, as a rule, no more than 12 months; if the term is exceeded without a reason, or more than two contracts are signed in succession between the same parties for the same flat, the first is treated as a permanent-residence lease;
- the reason is written into the contract and the landlord proves it; without a reason the contract is treated as a permanent-residence lease from the moment it is signed (art. 7.2);
- rent under successive temporary contracts for the same flat rises no faster than the IRAV index (art. 17.8).
How the national rules relate to Ley 11/2025 in Catalonia is for the abogado (lawyer) to determine, and it also depends on whether the decree is validated.
The Constitutional Court has admitted a challenge to this law by Partido Popular deputies, as reported by que.es (16 June 2026); according to the same report, the law remains in force meanwhile. The outcome is unknown, and a repeal should not be built into the calculation, any more than the rules should be treated as final.
What risks the owner carries
Legal risk: a contract where the reason is recorded only as a formality will be reclassified as a housing lease, which brings a minimum term and a rent cap. Income risk: the premium for temporary lets shrinks, because rent in a stressed-market zone is no higher than the general cap. Evidence risk: without a document for the reason there is nothing to rebut the presumption. Regulatory risk: the rules may change by decision of the Constitutional Court or a new national act.
Whether this suits an owner who wants to let a flat during a renovation, a sale or a change of plans is for the abogado to decide from the text of the contract and the tenant's documents. The economics of renovating for rent, where these questions arise first, are covered in the article on renovation for rental.
Who medium-term rentals do not suit
If the calculation relies on a price above the cap thanks to the word "temporada", it will not work: temporary status does not lift the cap. It also does not suit those unwilling to collect and keep documents for every tenant, or those who need a guarantee of getting the flat back by the sale date: a permanent-residence contract can bind the owner for years. DNPI's approach to residential projects is described on the page on residential property.
Questions and answers
Can I let a flat in Barcelona for a few months at a free price?
Not under every contract. If the contract serves a housing need, the same rent cap applies in a stressed-market zone as for long lets. A free price remains for tourist rentals and for purely holiday contracts.
What is needed for a seasonal contract to be recognised as temporary?
The reason for the temporary nature and the tenant's permanent residence in the contract, supporting documents and their deposit together with the fianza (art. 66 bis of Ley 18/2007).
What happens if a seasonal contract is renewed?
If the tenant has not proven the reason for the temporary nature, the contract moves to the permanent-residence regime with a minimum term and extensions, counted from the first contract.
Will the law be repealed?
Unknown. The Constitutional Court admitted the challenge in June 2026, but the law applies until the court decides. The national Real Decreto-ley 29/2026 may also fail validation.
