Co-Living and Room Rentals in Barcelona: What Is Allowed
Long-term room rentals in Barcelona are allowed, but from 2026 the sum of rents for all rooms in a stressed-market zone cannot exceed the maximum rent for the whole flat.
Renting a flat by the room in Barcelona for more than a month is allowed, but since 1 January 2026 it is a housing lease, not a way round the rent cap. Under art. 66 ter of Ley 18/2007 on the right to housing, the sum of rents under all simultaneous room contracts cannot exceed the maximum rent for the whole flat if it is in a stressed-market zone. Tourist rental of rooms for under 31 days is banned in Barcelona under the PEUAT (special tourist-accommodation plan); check the current position with the Ajuntament. From 8.10.2026 a similar ceiling is also introduced by the national Real Decreto-ley 29/2026, but Congress has not yet validated it.
What is allowed and under which regime
I found no separate definition of "co-living" for a private investor in the law, so the format is determined by how the contract is built and who is party to it.
| Format | What the law says | What it means for the owner |
|---|---|---|
| Long-term room rental | Art. 66 ter.1 Ley 18/2007: the tenant gets exclusive use of the room and the right to use common areas for a fee | Housing-lease regime |
| Room for a temporary reason (study, work) | Art. 66 bis: the reason is written down and backed by documents | The same documents and deposit as in a medium-term rental |
| Tourist room for under 31 days | Banned in Barcelona under the PEUAT: Betevé of 10.12.2021 reported that the ban stays when the plan is modified, with a possible future ordenanza (bylaw); I have not confirmed any change | Not an option until the Ajuntament decides otherwise |
| Co-living as a building or operator | The law describes "alojamiento dotacional" (dotational accommodation) as shared housing for employment, study and similar needs (art. 34.5 Llei d'urbanisme as worded by Ley 11/2025) | It belongs to the equipamientos (public facilities) planning system, not to any ordinary flat |
Whether a specific building qualifies for the last format is decided by the Ajuntament and the planning department. It is a question for an arquitecto (architect) and an abogado (lawyer), not for an agency.
How the rent cap works for rooms
Art. 66 ter.3 says that letting a home by the room, or any other physical or contractual fragmentation, does not change the character of a housing lease or disapply its rules. If the flat is in a stressed-market zone, the sum of rents under several simultaneous contracts cannot exceed the maximum rent under a single contract for the whole flat.
Worked example, not a forecast. Assumption: the maximum rent for the whole flat is 2,000 € a month.
| Scheme | Rent per room | Total | Permitted |
|---|---|---|---|
| 3 rooms at 750 € | 750 + 750 + 750 | 2,250 € | No, 250 € above the cap |
| 3 rooms at 660 € | 660 + 660 + 660 | 1,980 € | Yes |
Real Decreto-ley 29/2026 introduces the same ceiling nationally: from 8.10.2026 art. 2.1 LAU treats the letting of a single room as a housing lease too, and art. 17.9 bars the sum of rents under simultaneous room contracts from exceeding the rent for the whole flat, with no link to a stressed-market zone. Congress has not yet validated the decree.
For a model built on the rooms adding up to noticeably more than the flat as a whole, the ceiling in a stressed-market zone limits revenue. The rent ceiling for a flat is calculated under the zone's rules (how it works in Barcelona).
What co-living operators do
3Cat reported in February 2026 that the number of co-living places in Spain grew from 8,000 to 20,000 in two years, that Barcelona has about 5,000 of them, and that average rent is about 1,000 € per room against 600 € for an ordinary room in a flat. According to the same report, an industry representative holds that the model sits outside rent regulation, the tenants' union insists the rules apply, and the Generalitat is analysing how to approach the phenomenon. That is a journalistic overview, not a legal position, and I would not build a calculation on it.
What to check before buying a flat for room lets
- Cédula de habitabilidad (certificate of habitability). Art. 66 ter.2 requires compliance with the floor-area-per-person standards and the maximum number of occupants stated in the cédula (what a cédula is).
- Comunidad bylaws. The building's statute may restrict activities in flats (art. 553-11.2.e of the Código Civil de Cataluña), so it must be read before renovation.
- Zone status. The cap applies while the flat is in a stressed-market zone; the current list is checked on the date of the contract.
- Documents for the temporary reason, if rooms are let to students or for work.
- Regulation on the horizon. The Constitutional Court is hearing a challenge to Ley 11/2025, and the rules may change.
Who this format does not suit
It does not suit those counting on a rent premium from splitting into rooms: in a stressed-market zone the ceiling is set for the whole flat. It also does not suit anyone without an operator able to handle several contracts, deposits and tenant disputes, or anyone who wants predictable income without dealing with tenants. DNPI has no completed room or co-living projects: the published cases, Sitges and Compte de Urgel, concern a plot of land and a flat. The economics of renovating for rent are covered in the article on renovation for rental.
Questions and answers
Is it legal to rent a flat by the room in Barcelona?
Yes. For a term of more than a month it is a housing lease with the rent rules applied. Tourist rental of rooms for under 31 days is banned under the PEUAT; the status is checked with the Ajuntament.
Can I get more for the rooms than for the whole flat?
Not in a stressed-market zone: under art. 66 ter.3 of Ley 18/2007 the sum of rents for the rooms cannot exceed the maximum rent for the whole flat. The national Real Decreto-ley 29/2026 (art. 17.9 LAU) introduces the same limit with no link to the zone, but has not yet been validated.
Is a cédula needed to rent out rooms?
Yes, the floor-area-per-person standards and maximum occupancy come from the cédula de habitabilidad. Without it the format cannot be treated as permissible.
What is co-living in the eyes of the law?
I found no definition for a private investor. The law describes housing for temporary needs in shared use as an element of equipamientos (alojamiento dotacional), and whether it applies to a specific building is checked by an arquitecto.
