Spanish mortgages for autónomos and business owners: what banks see

The law assesses an entrepreneur by the same criteria as an employee, but the bank counts from the income on the tax return. How that limits the loan amount and what to prepare in advance.

A self-employed person (autónomo) or company owner gets a mortgage in Spain under the same rules as an employee: the bank must assess employment, current and future income, savings and obligations already taken on (art. 11 Ley 5/2019). The difference lies in the evidence. According to the Banco de España, banks usually do not lend more than 80% of the tasación (valuation) and keep the debt burden within 30–35% of income (Banco de España).

A mortgage for an entrepreneur is an ordinary mortgage loan in which income is proved with tax returns and the business's accounts, not a payslip. Hence more documents and a longer check.

What the bank must check for any borrower

The law does not divide borrowers into employees and entrepreneurs, it lists factors. Under art. 11 of Ley 5/2019 the bank takes into account employment, current income and income expected over the whole term of the loan, assets, savings, fixed expenses and obligations. The assessment cannot be based mainly on the value of the collateral (art. 11.3), and the loan is granted only if it is likely to be serviced (art. 11.5).

Practice takes over from there. The bank checks the credit history in the Banco de España's CIRBE (central credit register) and in a private solvency file (art. 12 of the same law), and if it refuses it must say so in writing and give reasons (art. 11.6).

Why income on the tax return decides, not turnover

The bank looks at taxable profit, not at the money that passed through the account. Legitimate deductions that reduce tax also reduce the income from which the bank calculates the payment. A company owner who pays themselves a small salary and leaves the profit in the company looks, on paper, more modest than their real position.

This is resolved in advance, not at the moment of application. Discuss with your accountant how your income appears in the returns of recent years and what part of the company's profit the bank will be able to count. The explanation of one-off dips, a change of activity or a large expense is prepared in writing.

How much you can borrow: a worked example

Worked example, not a forecast. An assumed rate of 4% a year over 25 years, which gives a payment of about 528 € a month for every 100,000 € of loan. A burden of 35% of income by the Banco de España's benchmark, no other loans. A flat of 500,000 €, valuation equal to the price, the 80% limit gives a loan ceiling of 400,000 €.

ScenarioIncome on the returnPayment at 35%Loan by incomeWhat limits it
Profit reduced by deductions60,000 € a year1,750 €about 331,500 €Income
Profit shown more fully90,000 € a year2,625 €about 497,300 €Collateral, 400,000 €

The difference between the scenarios is about 68,500 € of loan, which in the first case has to be replaced with your own money. On top of that come own funds for taxes: ITP (transfer tax) in Catalonia is 10% on the part of the price up to 600,000 € (ATC), in the example 50,000 €. Your own parameters are easy to run in the calculator.

What to prepare before talking to the bank

It is worth starting with financing before searching for a flat. For an entrepreneur the check takes longer, and the arras contract (deposit agreement) should not set a deadline the bank objectively cannot meet.

  1. Tax returns and company accounts for recent years, in one package and with a translation if the business is not in Spain.
  2. Certificates of no debts to the tax authority and social security.
  3. Statements for personal and business accounts, separately.
  4. A list of current loans and guarantees, including company loans.
  5. A written explanation of atypical figures.
  6. A question to the bank or broker: which income they will count, profit after tax, an average over several years or something else. Under Ley 5/2019 the bank must say in advance and clearly which documents it needs and by when (art. 12.1).

If income comes from abroad, currency and foreign accounts are added; this is covered in the article mortgage on income from abroad. Banks treat business income differently, so comparing proposals is often more convenient through an intermediary; the questions for them are collected in the piece what to ask a mortgage broker.

When this route does not suit

A mortgage to an individual on business income suits poorly if the activity has run for fewer than a few years: the bank has nothing to build an income forecast on. It is also hard when the profit on the returns swings sharply from year to year for no clear reason.

A separate case is a purchase in the name of a company. Ley 5/2019 applies when the borrower, surety or guarantor is an individual (art. 2.1). If the loan is taken by a company without a personal guarantee, the law's protection, including the mandatory FEIN (Ficha Europea de Información Normalizada, the standard information sheet) ten days before signing, may not apply: that is a question for the abogado (Spanish lawyer). How buying through an SL (limited company) differs in taxes and risks is covered in the article SL or individual.

Questions and answers

Can an autónomo in Spain get a mortgage on the same terms as an employee?

The law requires the bank to assess both by the same factors: employment, income, savings, obligations. In practice an entrepreneur needs more documents, and the final terms depend on the bank and the income history.

Which income does the bank count for an entrepreneur?

Usually income proved by tax returns and accounts, not the turnover through the account. Which exact figure a particular bank will take is asked before the application is filed.

What share of income can a mortgage payment take?

According to the Banco de España, banks usually aim for a burden of no more than 30–35% of income, counting other debts. That is bank practice, not a legal rule.

Is the bank obliged to explain a refusal?

Yes. Under art. 11.6 of Ley 5/2019 the bank reports the refusal in writing and without delay, with reasons, and if the decision rests on data from a register, it names that register.
