Regulatory Risk in Catalonia: The Changes That Have Already Happened
In six years Catalonia lost its rent law, gained stressed-market zones and changed the purchase tax, and in 2026 Congress repealed three housing decrees. A chronology and how to price it in.
Regulatory risk in Catalonia is the probability that the rules on rents, taxes or the use of a property change between purchase and exit. It has materialised every year: the Catalan rent law was found unconstitutional, stressed-market zones were introduced, ITP was made progressive, and in 2026 Congress repealed three housing decrees. Below are a chronology and a way to build this into the calculation.
Which changes have already happened
The table is limited to acts that directly affect buying, letting and selling a property.
| Date | Act | What changed | How it ended |
|---|---|---|---|
| 18.09.2020 | Ley 11/2020 of Catalonia | Rent cap in "tenso" (stressed) zones | Sentencia 37/2022 of 10.03.2022 declared arts. 1, 6–13, 15, 16.2 and a number of other provisions void, with effect for the future |
| 24.05.2023 | Ley 12/2023 | Stressed-market zones, gran tenedor (large holder) status | From 16.03.2024 the zone covers 140 municipalities of Catalonia, including Barcelona (Ministerio de Vivienda) |
| 07.11.2023 | Decret llei 3/2023 | Licence for tourist lets, a five-year transition period | The Constitutional Court rejected the challenge: STC 64/2025 of 13.03.2025 |
| 24.04.2024 | Decret llei 6/2024 | Definition of alquiler de temporada (seasonal letting), tanteo y retracto (pre-emption rights) of the Generalitat | The Diputació Permanent did not validate the decree, and it was repealed from 27.05.2024 (DOGC no. 9170) |
| 02.01.2025 | LO 1/2025 | Residency for buying property abolished from 03.04.2025 | Applications filed before that date follow the old rules |
| 25.03.2025 | Decret llei 5/2025 | ITP on a 10–13% scale, 20% for a gran tenedor | In force from 27.06.2025, per ATC |
| 20.03.2026 | RDL 8/2026 | Extension of tenancy contracts at the tenant's request | Repealed by Congress on 28.04.2026 |
| 29.09.2026 | RDL 26/2026 and RDL 27/2026 | A housing package of measures; extension of tenancy contracts | Repealed by Congress on 02.10.2026 (RDL 26, RDL 27) |
| 06.10.2026 | RDL 29/2026 and RDL 28/2026 | The same two packages again: housing; tenancy extension | RDL 29/2026 in force from 08.10.2026, RDL 28/2026 enters into force on 15.11.2026; as of 12.10.2026 Congress has not validated them |
There is one rule: a decreto-ley enters into force immediately, but under art. 86 of the Constitution Congress must decide its fate within 30 days. So a provision from a decree cannot be treated as a basis for the calculation until it is validated.
What follows for a project calculation
The key takeaway from the chronology: the rule you count on at exit may not survive the length of the project. The two sides of this risk differ.
A rule can appear. In art. 1, RDL 29/2026 restricts, until the end of 2030, legal entities with gran tenedor status and organisations that buy property or portfolios of defaulted mortgage loans markedly below valuation from buying housing for less than 70% of its market value as appraised by an independent tasadora (valuer). The decree has not yet been validated by Congress, so it is not included in a calculation as an established rule. There are exceptions, for example for affordable housing. A gran tenedor under Ley 12/2023 (art. 3.k) is an owner of more than ten residential properties or more than 1,500 m² of residential floor area, and in a stressed-market zone the threshold may be lowered to five properties. Whether your buyer or your company falls under this is determined by an abogado (lawyer).
A rule can disappear. The 2020 rent cap was in force for about a year and a half. The tenancy extension under RDL 8/2026 was in force from March to April 2026. What happens to extensions tenants managed to request is assessed by an abogado on the specific contract.
A practical sequence for a project:
- On the purchase date, list the rules your exit depends on: letting, taxes, use of the property, the pool of buyers. Next to each, the number of the act and its status: a law, a decreto-ley before validation, a draft.
- Calculate the exit twice: under the rules in force and under the worst known version. For example, letting with a contract extension instead of a free revision of rent.
- For rules already in the BOE but not validated, do not count on a benefit. Count only the restriction.
- Check the BOE and the DOGC before the arras (deposit contract), before signing the works contract and before listing for sale.
- In the contract with the operator, find who bears the effect of a change in law: the timing, the costs, your exit.
A worked example, not a forecast. The plan: a year of letting at 3,000 € a month, then a sale of the vacant property for 900,000 €. Holding costs 2,500 € a month, 700,000 € invested at 3% (an assumption). A law extends the contract by two more years on the same terms. Rent over two years is 72,000 €, costs 60,000 €, the cost of frozen capital 42,000 €. The delay costs 30,000 € (72,000 − 60,000 − 42,000), about 3.3% of the price, and that is before any discount for a property with a tenant. This line is calculated as a scenario before the purchase, not after a decree is issued.
Who this analysis matters more for
Projects with an exit through letting. A sale depends on the law less, but not zero: taxes change (the ITP scale changed in 2025), as do the pool of permitted buyers and approval times. A project whose exit rests on a single rule cannot be called resilient. What to do if a rule collapses is covered in the article on exit plan A/B/C. For the general risk map see the article on the risks of investing in Barcelona, and for the tax side the tax map. More on tourist licences in the article on the ban by 2028.
Questions and answers
Which property laws in Catalonia have changed most often?
The rules on letting (the rent cap, stressed-market zones, tenancy extensions), the purchase tax and the regime for tourist lets. The specific acts and dates are in the table above.
What happens to the consequences of a decree if it is not validated?
The decree ceases to apply, but events during its life do not disappear automatically. Under RDL 8/2026 the question concerns extensions requested before the repeal. A specific case is assessed by an abogado, and in a dispute the court decides.
How do I know that a rule is in force right now?
Open the consolidated text in the BOE or the DOGC and look at the version history: it shows which changes were repealed. News and law firms' summaries help, but the source for a calculation is the text of the act.
Can I know in advance how the law will change?
No. You can only find out which drafts and decrees have already been published. The rest is covered by a margin and a second exit option.
