Riera floods and wildfires: villa risks in Maresme, Garraf, Collserola
A villa by a riera or on a wooded slope carries flood and wildfire risk. What is known for Maresme, what the owner must do, and what the Consorcio covers and what it does not.
A villa next to a riera (a seasonal stream bed that floods in heavy storms) or on a wooded slope carries two physical risks that the listing does not mention: flood and wildfire. The physical risk of a plot is the likelihood that water or fire damages the property, plus the cost of protecting and insuring against it. For Maresme there are public figures: a study by the Consell Comarcal del Maresme reviewed 65 rieras, and 3Cat, reporting it on 22.04.2026, puts the number of people exposed to the effects of a flood in a severe storm at 105 000. For Garraf and Collserola I found no comparable open figure for villas.
What is known about flood risk in Maresme?
The Consell Comarcal del Maresme study went through the basin's 65 rieras one by one and singled out ten where action is needed first. The selection criteria were the number of people in the risk zone, possible economic damage, the condition of the riera itself and the complexity of the works. Top of the list are the riera d'Arenys, the Rec Viver and the riera d'en Cintet in Vilassar de Mar; the ten also include the rieras of Cabrils, Premià, Argentona and Calella.
The causes are named plainly: poor maintenance of channels, vegetation that blocks the flow, bridges that act as bottlenecks, and downpours that have become more frequent and shorter. The long-term plan to 2050 puts the cost of adapting the rieras at 685 M€: 500 M€ for urban stretches, the responsibility of the municipalities, and 185 M€ for non-urbanised ones, the responsibility of the Agència Catalana de l'Aigua (the Catalan water agency).
The ranking was built on population, economy, condition of the riera and complexity of the works, not on individual plots. A riera outside the top ten does not mean a given villa carries no risk.
What must the owner of a villa in a forest area do?
Catalan Law 5/2003 on the prevention of forest fires (consolidated text, which I checked against the BOE version) applies to urbanizaciones (residential estates), houses and structures in a forest area and in the 500-metre band around it. It requires:
- an external protection strip at least 25 metres wide, free of dry vegetation and with thinned trees;
- a wildfire self-protection plan;
- a network of certified hydrants;
- private roads and ditches cleared of dry vegetation.
The duties fall on the comunidad de propietarios (owners' association) of the urbanización or on the entidad urbanística colaboradora (EUC, a collaborating urban-planning body). If neither exists, the plot owners are jointly liable. A standalone house outside an urbanización answers for itself. Fines go up to 100 000 € for very serious breaches, for example no protection strip or no hydrants (arts. 9, 11). If the obliged parties do not do the clearing, the municipality does it and may charge a fee for it (art. 4.4). In gated estates this comes down to the EUC: fees and votes.
What does insurance cover, and what does it not?
The Consorcio de Compensación de Seguros (the state insurance compensation body) covers "extraordinary risks" from a closed list. In its standard clause for property damage natural events are listed as follows.
| Event | On the Consorcio list | What to check in the terms |
|---|---|---|
| Extraordinary flood (inundación extraordinaria) | Yes | The surcharge in favour of the Consorcio must have been paid |
| Atypical cyclonic storm, wind above 120 km/h, tornado | Yes | Evidenced by AEMET certificates |
| Wildfire | No, fire is not on the list | A matter for the ordinary policy; read the exclusions |
| Landslide, slope movement | No, unless it occurs together with an extraordinary rain flood | Separate exclusion in the clause |
Now the details. The Consorcio pays when the risk is not covered by a private policy or when the insurer cannot meet its obligations. A new policy has a waiting period of seven calendar days. Damage from a defect in the item itself and from its evident lack of maintenance is excluded, so a neglected property can give the insurer grounds for a dispute. A 7% deductible on property damage exists, but it does not apply to housing.
Fire is decided by the terms of the ordinary policy: sum insured, exclusions, requirements for the protection strip. These are read before the arras (the deposit contract), not after. General overview: liability and property insurance.
How do you check a plot's risk before making an offer?
- Open the ACA viewer: the agency publishes the flood-zone map and the hazard and risk maps there.
- Measure the distance to the channel. Along a channel there is a five-metre easement zone and a 100-metre zona de policía (a buffer where land use and activity are restricted); the widths can be changed (art. 6 of the consolidated Ley de Aguas, the Water Act). What can be built or altered there is for the abogado (lawyer) to determine.
- Ask the ayuntamiento (town hall) whether the urbanización is covered by a plan de delimitación under Law 5/2003 and whether it has a self-protection plan. In Sitges the POUM (municipal urban plan) has a separate volume on flood-prone zones next to the riera, in urban and urbanizable land.
- Ask the seller to state in writing any past damage and insurance claims.
- Get an insurer's quote for the specific property and compare it with the maintenance budget. General overview: floods and climate risk for property.
How much can having no cover cost?
Worked example, not a forecast and not market statistics. Assumptions: a villa worth 2 M€, insurance and protection-strip maintenance of 6 000 € a year, a two-year project, flood damage of 5% of value.
| Scenario | Costs and losses |
|---|---|
| Insurance and maintenance over 2 years | 12 000 € |
| 5% damage with the risk insured | depends on policy terms and deductible |
| 5% damage with no cover | 100 000 € |
Between 12 000 € and 100 000 € the gap is more than eightfold. That is why the quote has to be obtained before the deal: if the insurer excludes the risk, the loss falls entirely on the owner.
When does this analysis not work?
It does not replace an engineer's report on the specific parcela (plot). The Maresme study assesses rieras, not lots, and for Garraf and Collserola I have no open figure on the number of villas in a risk zone. A buyer who proceeds without a technical check and without asking an insurer gets no help from open figures either: they give a direction, and the decision comes from the document on the property. The order of checks for land is described on the land strategies page, and the restrictions around Barcelona are covered in the article on the PDUSC, Garraf and Collserola.
Questions and answers
Does the Consorcio cover a wildfire at a villa?
No, wildfire is not on the Consorcio's list of extraordinary risks, which includes flood, earthquake, atypical cyclonic storm and a few other events. Fire goes through the ordinary policy, and its terms need to be read before buying.
How many rieras in Maresme are classed as priority?
According to the Consell Comarcal del Maresme study, as reported by 3Cat on 22.04.2026, ten of the 65 rieras are named as priority, for example those of Arenys, Cabrils, Premià and Argentona. This is an assessment by population and economy, not for each plot.
Who pays to clear the protection strip in an urbanización?
Under Law 5/2003 the duty lies with the comunidad de propietarios or the entidad urbanística colaboradora, and where neither exists the owners are jointly liable. The municipality can carry out the works in their place and charge for it.
When does the Consorcio pay for flood damage, and when the insurer?
The Consorcio pays if the risk is not covered by the ordinary policy or the insurer cannot meet its obligations, and if the surcharge in its favour has been paid. A new policy has a waiting period of seven calendar days.
Can you find out whether a plot is in a flood zone?
Yes, the ACA publishes flood hazard and risk maps in a public viewer. The result should be checked with an abogado and against the ayuntamiento's plan before signing the arras.
