Gated urbanización with an EUC: fees and votes when buying a villa
A villa owner in an urbanización with an EUC pays fees for road and infrastructure upkeep and votes under the statutes. What the law says and how to check for debts before buying.
A villa owner in an urbanización (a residential estate) with an EUC pays fees for the upkeep of its infrastructure and votes under the statutes of that body. An EUC, or entitat urbanística de conservació (urban maintenance entity), is an association of an estate's owners that, by law, is responsible for maintaining the infrastructure that has been built. There is no general fee figure for Catalonia: the amount is set by each EUC's budget, and the law only defines when the duty arises and how it is collected. Below: where the duty comes from, how to check debts and the statutes before the arras (deposit contract), and the cases where such an estate is a poor fit.
What is an EUC and where do its powers come from?
The Catalan urban planning law classes juntas de conservación (maintenance boards) among the entidades urbanísticas colaboradoras (collaborating urban-planning bodies). These bodies are set up by public document and acquire legal personality on entry in the Registro de Entidades Urbanísticas Colaboradoras of the Dirección General de Urbanismo (art. 123.1 TRLU). The duty to maintain the urbanización arises if the owners took it on voluntarily or if the plan imposes it on justified grounds (art. 44.1.g). The ayuntamiento (town hall) may also itself create an entidad de conservación when accepting the works if the estate was built by a single owner (art. 131.5).
The term of a duty imposed by the plan is not unlimited. Under disposición final 4.ª, until the government adopts a decree on the matter (I did not check whether it has been adopted), the plan may impose maintenance until building in the zone reaches two thirds and for no longer than five years after acceptance of the works. But estates differ: some have a duty fixed by the plan and others one the owners took on voluntarily. Which applies to yours is shown by the statutes and the ayuntamiento's decision, and the conclusion is for the abogado (lawyer) to draw.
How are fees and votes calculated?
The law gives no figures. The fee is determined by the EUC's budget and by the coefficients the statutes assign to plots: under compensación básica, cuotas de urbanización depend on the plots' coefficients (art. 134.4). Voting rights are also set by the statutes, and this is the most important thing to read: how many votes you have, what majority is needed for expenses, and who decides on an extraordinary levy.
I found no open statistics on the average fee in Vallpineda, Montemar and other estates, and whether they have an EUC and what statutes it has must be checked by request. EUC decisions on administrative matters can be appealed to the ayuntamiento (art. 123.2). If an owner does not pay fees under a reparcelación (land readjustment) system, the administration may collect them by compulsion through apremio (art. 122.5).
What duties does the EUC cover in your place?
Besides roads and networks, there are fire-safety requirements. Under Catalan Law 5/2003 (text), the protection strip of at least 25 metres, the self-protection plan and the hydrants are provided by the comunidad de propietarios (owners' association) or the entidad urbanística colaboradora, and where neither exists the owners are jointly liable (art. 4). Fines for very serious breaches go up to 100 000 € (art. 11). More on the risk: wildfires and rieras.
What should you check at the EUC before buying?
| What to request | From whom | Why |
|---|---|---|
| Statutes, voting rules, list of members | The EUC or its administrator | How many votes you have and who decides on spending |
| Budget, latest acta (minutes), estimate for upcoming works | The EUC | Size of the regular and extraordinary fee |
| Written certificate of no debt on the plot | The EUC | That the seller's debt does not pass to you |
| Nota simple | Registro de la Propiedad (land registry) | Whether there are charges and a garantía real (real security) note (art. 134.1) |
| Certificado de régimen urbanístico | Ayuntamiento, one-month response period (art. 105.1) | Who must maintain the urbanización and until when |
A no-debt certificate is not named in the articles of the law that I read, but without it you are buying the risk of other people's payments. If the estate has infrastructure deficits, ask the ayuntamiento about the plan to correct them: Ley 3/2009 on regularising such estates was repealed by Ley 11/2025. The general sense of liability for owners' association debts is covered in the article on community debts.
How much can it cost in a year? A worked example
Worked example, not a forecast and not the parameters of Vallpineda or Montemar. Assumptions: a mandatory fee of 4 800 € a year, an extraordinary levy of 12 000 € to repair the road in year one, a two-year project.
| Item | Amount |
|---|---|
| Regular fees over 2 years | 9 600 € |
| Extraordinary levy | 12 000 € |
| Total | 21 600 € |
For a villa worth 2 M€ this is about 1,1% of the entry price over two years. But if the EUC is in debt or the statutes allow unlimited levies, the figure can differ, and that is why the statutes are read before the deal, not after.
Who is a gated urbanización with an EUC not suited for?
Anyone who needs full control over spending: part of the decisions are taken not by the owner but by the EUC's assembly. Anyone buying with a short-term exit: the buyer at resale will ask for the same documents. And anyone facing an EUC in conflict or with debts: such stories drag on, and who is responsible for a debt is for the abogado to decide. Such an estate suits an investor who can see the statutes, the budget and the minutes of meetings and builds the fees into the entry price.
Plots and houses on the outskirts are covered in the articles on Penedès and Garraf and on the obligations of an urbanización owner. How residential assets are handled is described on the residential property page.
Questions and answers
What is an EUC in Catalonia?
An entitat urbanística de conservació is an association of an estate's owners that maintains the infrastructure that has been built. It is one of the entidades urbanísticas colaboradoras and acquires legal personality once registered.
Who pays EUC fees?
The plot owners in the urbanización, under the statutes' rules and coefficients. The specific amount and the voting system are shown by the EUC's statutes and budget.
Does the seller's debt pass to the buyer of the villa?
Under compensación básica, plots secure the legal obligations as garantía real, and a note to that effect must appear in the registry (art. 134.1). Whether this extends to the debt of a specific EUC is for the abogado to decide, which is why the no-debt certificate is requested before the arras.
Can an EUC decision be appealed?
EUC decisions on administrative matters are appealed to the ayuntamiento (art. 123.2). Decisions on private matters, such as fee disputes, are examined by the abogado under the statutes.
How long does the duty to maintain the urbanización last?
It depends on the basis: a voluntary duty or one imposed by the plan. For one imposed by the plan, until the decree is adopted the limit of two thirds of building and five years after acceptance of the works applies, and each estate has its own history.
