City tanteo in Eixample and Ciutat Vella: how to price it in

All of Barcelona's municipality is a tanteo zone for whole buildings. Which buildings the city bought, the criteria it uses, how the price threshold is calculated and how long the procedure takes.

The whole territory of Barcelona is declared a tanteo and retracto zone for whole residential buildings, meaning those used mainly as housing. Tanteo is the Ajuntament's (city council's) right to buy the building on the terms of the transaction in place of the buyer. The seller must notify the city in advance, and the city decides within two months whether to buy the building on the terms stated. The rule applies under the ordinance finally approved by the Plenary on 19 December 2025 and published in the BOPB on 29 December 2025 (BOPB); the thresholds and deadlines below come from its text.

Which transactions are subject to the city's tanteo?

Whole residential buildings used mainly as housing (Article 5.1). Individual flats are covered only in special zones that the city may designate additionally (Article 5.2). The sale of shares or holdings in commercial companies tied to real estate also falls under the rule if the company owns such buildings; transactions within one group of companies with the same business purpose are excluded (Article 4.2). The city's right and the Generalitat's right rest on different grounds; the second is covered in the articles on Ley 11/2025 and tanteo and retracto of the Generalitat.

Duration under Article 6: six years from 21 December 2018, with the option of extension by decision of the Plenary for a further six years at most. According to the agenda of the Plenary session of 29 November 2024, a six-year extension was to be approved finally, effective from 21 December 2024 to 20 December 2030 (Plenary agenda). This is an agenda, not minutes or a publication in the DOGC, so whether the extension is in force on the transaction date is confirmed separately.

Which buildings did the city buy in Eixample and Ciutat Vella?

Four transactions that the city announced itself.

BuildingDate of announcementWhat is known
Carrer de la Diputació, Dreta de l'Eixample07.08.202423 flats, of which 21 were used as tourist accommodation or short-term rental, 2 commercial units; total outlay of 8,7 M€ including renovation, purchase price not stated in the announcement
Carrer d'en Santcliment, Raval (Ciutat Vella)04.07.20249 flats, one let; purchase for 800 000 €, total of 2,46 M€ with renovation of 1,66 M€
Carrer de Villarroel, Antiga Esquerra de l'Eixample01.02.2023purchase for 4 M€, renovation of about 1,63 M€; after reconstruction 16 flats, almost all vacant; outlay per m² 27,08% below the average for the Antiga Esquerra neighbourhood
Carrer del Consell de Cent, Nova Esquerra de l'Eixample01.02.20238 flats and 2 units, of which 4 flats let; purchase for 1,9 M€

Sources: Dreta de l'Eixample, Raval, two purchases in Eixample. These are city announcements, not statistics. The purchases were made before the ordinance was approved in December 2025, under the right established by the 2018 plan.

What criteria does the city use?

The ordinance sets them out in Article 8 and in the first additional provision. Priority goes to: a building of more than ten flats and a building with vacant flats; tenants with a forced contract extension and people at risk of social exclusion; neighbourhoods at risk of gentrification and economic vulnerability; areas where the city has bought little in the last two years; buildings in poor condition or with anomalous use under Ley 18/2007. The reasons for each of the four transactions are not fully disclosed in the city's announcements; all that is visible is that in three buildings the flats were almost all vacant or used as tourist lets, and in the fourth half were let.

How does price affect the decision?

For whole buildings the city may take a maximum price into account: the first additional provision says the economic conditions "may be taken into account". The threshold is calculated as follows. Take the price of registered second-hand housing transactions in the neighbourhood (barri) for the last published quarter of the municipal statistics and subtract the estimate of the renovation needed; the price of a commercial unit is taken as 70% of the housing price. Then an occupancy coefficient is applied: 0,7 for fully irregular occupation, 0,8 for partial, 0,9 for regular, 1 for a vacant building. If the stated price is above the threshold, the city refuses at once; if the excess is less than 10%, a favourable opinion is allowed as an exception.

Worked example, not a forecast: residential floor area of 1 000 m², registered transaction price in the area of 4 000 €/m², renovation of 1 000 €/m². Base of 3 M€.

BuildingThresholdPrice in the noticeResult
Vacant, coefficient 13 M€3.2 M€6,7% above, exception possible
Vacant, coefficient 13 M€2.9 M€within the threshold
Regularly occupied, coefficient 0,92.7 M€3.2 M€18,5% above, refusal

The lower the stated price relative to the threshold, the smaller the chance of a refusal on price. The real calculation is done by the city itself.

How long does the procedure take?

The owner notifies the city in writing with a package of documents: nota simple (property registry extract), cadastral certificate, price, payment terms, occupancy details, encumbrances and others (Article 10). While the package is incomplete, the clock does not start. The city decides within two months; inspection of the building suspends the period for 15 days at most. If the city buys, it accepts the price and terms from the notice, and the escritura (public deed) is signed within three months. The notice lapses if the transaction does not complete within six months; a sale without notification gives the city the right of retracto (Articles 18 and 20), which the city decides within three months of learning of the transaction. The notary must require proof of notification before the escritura is signed and record this in the document (Article 17).

It is worth discussing with the abogado (lawyer) whether to include in the contract: a condition that the transaction depends on the city's decision; a period for signing after the city's refusal; the allocation of costs if the city buys. The wording of the arras (deposit) is prepared by the abogado. The schedule should allow two months for the city's reply and time for collecting documents.

Who should not rely on this analysis?

Anyone buying a single flat or a villa: the ordinance concerns whole buildings, and special zones for flats must be looked up separately. Anyone expecting a ready probability of purchase: we found no open statistics on refused notices, and the criteria give a guide, not a forecast. And anyone handling a building purchase without an abogado: an incomplete package delays the period. Historic buildings also fall under other regimes: restrictions in Ciutat Vella.

You can work out the timing for your own property in the calculator; how residential projects are handled is described on the residential property page.

Questions and answers

Can the Ajuntament buy an Eixample building that I want to buy?

Yes, if the whole building is used mainly as housing: all of Barcelona is a tanteo and retracto zone for such buildings. The city receives the seller's notice and within two months decides whether to buy on the terms stated.

Does the right extend to a flat or a villa?

Under Article 5.1, no, only to whole buildings. Flats can be included only in special zones designated by the city, so a specific address is checked separately.

Does it cover the sale of shares in an SL that owns a building?

Yes: Article 4.2 extends the right to the sale of shares and holdings in real-estate-related companies that own such buildings; transactions within one group with the same business purpose are excluded.

At what price does the city buy the building?

At the price and on the terms in the seller's notice, if it decides to buy. But the city calculates the price threshold itself: if the stated price is above the threshold, it refuses.

What happens if a building is sold without notifying the city?

The city gets the right of retracto: it can buy the building after the transaction, within three months of learning of the transfer. The notary must check the notification before the escritura, so a missed step should come to light at signing.
