When a Property Project Should Be Stopped: Stop Criteria

Stop a project when the remaining costs and risk exceed the expected rise in price, not when the money already spent hurts. How to write criteria before entry and count the decision.

A project should be stopped when the remaining costs and risk exceed the expected rise in the sale price. What has already been spent plays no part in this comparison: it cannot be recovered either by continuing or by stopping. Stop criteria are written down before entry, while there is no fatigue and no resentment about the deal, and are tied to figures and dates that can be checked.

Which stop criteria to write before entry

A criterion works if it has a threshold and an action. The thresholds below are examples: each project sets its own.

AreaExample thresholdAction when triggered
Law and titleThe nota simple shows an encumbrance or a double registration that was not in the seller's documentsDo not sign the arras (deposit contract) or stop the deal, consult an abogado (lawyer)
BudgetThe contingency reserve is used up while less than half the works are donePause the works, recalculate the budget, the investor decides in writing
TimelineThe licence is suspended or the delay exceeded the margin in the calculationExit option B or C, see exit plan A/B/C
Exit pricePrices of closed deals are below the project's break-even pointRecalculate, discount or sell as is
FinancingThe loan rate or terms are such that the project cannot bear the cost of money. For reference: the 12-month euríbor in August 2026 was 2.954%, 0.840 percentage points higher than a year earlier (Banco de España)Refinancing or a shorter term
ContractorMissed stages and failure to meet written requirementsReplacement under the contract terms, see contractor risk

Before the arras is signed, exit costs the size of the deposit, and this is the cheapest moment to stop. How it differs across types of arras is described in the article on arras penitenciales, confirmatorias and penales.

How to decide whether to continue or stop

There is one rule: continue while the expected price of the finished property is higher than the sum you would get by stopping, plus all the remaining costs and the cost of time.

A worked example, not a forecast. An apartment is bought for 600,000 €. Of a renovation plan of 80,000 €, 40,000 € has been spent. Opening up reveals hidden damage worth 30,000 €. The remaining costs: 40,000 + 30,000 = 70,000 €. The works and the sale will take about four more months, and holding costs over that time are 12,000 € (an assumption). A sale now "as is" would bring 680,000 €.

  • The finished-property threshold: 680,000 + 70,000 + 12,000 = 762,000 €. If comparable closed deals give 820,000 €, continuing yields 58,000 € more than stopping (820,000 − 70,000 − 12,000 − 680,000).
  • If the finished property is worth 750,000 €, continuing loses to stopping by 12,000 €.

The 640,000 € already spent (the purchase plus half the renovation) plays no part in the calculation. This is the most common mistake: "we have already put in so much" is not an argument. The "as is" price must be real, that is, confirmed by at least two or three buyer assessments, not wished for.

What to do when a criterion is triggered

  1. Stop new commitments: orders, payments, signing. Works already under way are brought to a safe state.
  2. Record the facts in writing: what was found, when, which documents.
  3. Recalculate the project by the rule above with three options: fix it, sell as is, stop and exit.
  4. Make the decision and write it down with a date. If the project is joint, all parties sign the decision.
  5. Set a review date. A stop is not always final.

How this relates to the terms with DNPI

DNPI’s fee is 50% of profit, so stopping with a sale "as is" reduces both the investor’s result and the fee. If the investor's return for the whole project is below the contractual 10%, DNPI pays contractual compensation out of its own fee within the limits of the contract. This is not a guarantee of capital. What to clarify before signing: who has the right to stop the project, how the result is calculated if it is stopped before the sale, and how the costs of stopping are shared. These provisions are written in the contract for the particular project.

Who it does not suit: someone who is not ready to accept a loss and stop the project when the calculation demands it. Criteria without readiness to act remain a list. Questions and answers

When should an investment property project be stopped?

When the expected price of the finished property falls below the sum of the remaining costs, the cost of time and the "as is" sale price, or when a criterion written in advance is triggered: legal, budget or timeline.

Is the money already spent taken into account when deciding to stop?

No. Only future costs and future receipts matter for the decision. What has been spent affects the project's outcome, but not the choice between continuing and stopping.

Who makes the decision to stop if the project is joint?

The contract determines it. Ask before signing: who has the right to stop the project, in what form, and how the costs are shared.

Can a stopped project be resumed?

It can, if the reasons for stopping have been removed and a new calculation gives a positive decision. For this, a review date is set when the project is stopped.
