Renting out a flat in Barcelona in 2026: a guide for the owner
Renting out a flat in Barcelona starts with the rent cap and the lease type, not the advert. What RDL 28/2026 and RDL 29/2026 changed, what you cannot charge the tenant and where the deposit goes.
Renting out a flat in Barcelona means signing a lease under the Ley de Arrendamientos Urbanos (LAU, the Urban Leases Act), in which the owner is responsible for the rent cap, the deposit and the condition of the home. The starting point is the cap: Barcelona is in a stressed residential market zone (TER/800/2024), and the new rent is limited by the last rent paid for that flat over five years. The deposit goes to the Incasòl (the Catalan land institute that holds rental deposits) within two months of signing (Incasòl).
Which type of lease to choose
Since 8 October 2026, under Real Decreto-ley 29/2026 (BOE), a homeowner has two regimes under the LAU: the lease of a main residence (alquiler de vivienda habitual) and the temporary rental of housing (alquiler temporal). A seasonal let is no longer treated as a lease for a use other than housing. Congress has not yet validated the decree-law, so before signing the current wording should be checked with an abogado (lawyer).
| Question | Main-residence lease | Temporary rental |
|---|---|---|
| For whom | The tenant's permanent home | A temporary move for a real, provable reason |
| Term | Extension up to 5 years (7 if the landlord is a company), then art. 10 | More than 31 days, as a rule no more than 12 months |
| Additional guarantee | No more than two months' rent | No more than one month's rent |
| Tenant's exit | After 6 months, with 30 days' notice | After one month, with 10 days' notice |
| Document for the Incasòl | SERPAVI report (state rent reference system) for leases from 26.03.2026 | Document on the purpose of the let for leases from 01.01.2026 |
Sources: consolidated LAU, arts. 9, 9 bis, 11 and 36.5; the document requirements are on the Incasòl page. Tourist letting is a separate regime outside the LAU (art. 5.e) with its own licences, and it is not part of this calculation. For the temporary regime in detail, see the article on mid-term rentals.
How to work out the permitted rent
The rent is calculated from the flat's history, not from adverts. Under article 17.6 of the LAU, in a stressed market zone the new rent may not exceed the last rent under a lease of that flat in the previous five years, with indexation. An increase of up to 10% is allowed in the cases set by the law: refurbishment or energy improvement completed within two years before the lease, or a lease of ten years or more. A gran tenedor (large landlord) is also subject to the state index cap, covered in the article on the rent cap in a stressed market zone.
Indexation is limited as well. Under RDL 29/2026, until 31 December 2027 rent above the state index cap does not rise at all, and in other cases, without a new agreement, it rises by no more than 2%.
What cannot be passed on to the tenant
After the October decree-law the list of prohibitions is longer. Under the LAU as worded by RDL 29/2026:
- agency fees and the cost of drawing up the lease may not be passed on to the tenant, directly or indirectly (art. 20.2);
- taxes tied to the property are not charged to the tenant, except those the tenant owes as the taxpayer (art. 20.1);
- comunidad (owners' association) costs can be passed to the tenant only under a written agreement stating the annual amount (art. 20.1);
- the tenant cannot be required to take out rent-default insurance (art. 36.5).
The owner's steps
- Check the documents for the flat: title to the property and the cédula de habitabilidad (habitability certificate).
- Choose the type of lease and, if it is temporary, obtain from the tenant a document proving the reason for the move.
- Find the last lease of the flat within five years and work out the rent cap.
- Check the candidate's ability to pay.
- Sign a written lease. If the owner is an individual who may need the flat for themselves or close family within five years, that condition has to be written into the lease from the start (art. 9.3).
- Take the deposit, which for a main-residence lease is one month's rent, and pay it into the Incasòl within two months; a lease in a foreign language is filed with a translation into Catalan or Spanish. Step by step in the article on registering the deposit with the Incasòl.
- Draw up an inventory of the flat's condition at move-in. At move-out the parties sign a document on the condition of the home: if there is none, or it does not record damage, the flat is treated as returned in normal condition (art. 36.7).
How much money the deposit ties up: a worked example
Worked example, not a forecast. Rent of 1,400 € a month under a main-residence lease. The owner receives a deposit of 1,400 € and transfers it to the Incasòl within two months. An additional guarantee is possible, but no more than two months' rent, that is, up to 2,800 €. If after a year the rent is below the state index cap and there is no new agreement, indexation until the end of 2027 is no more than 2%: plus 28 € a month.
When renting out on your own does not fit
Renting out on your own suits poorly an owner who lives abroad and cannot react quickly. From October 2026, a tenant's request for an urgent repair affecting habitability must be answered within 15 calendar days, otherwise the tenant may do the work and deduct it from the rent (art. 21.5); for a temporary rental the reply deadline is five working days (art. 21 bis). Owners not ready for such deadlines need a local manager. The tax side for a non-resident is covered in the article on tax on rental income of a non-resident.
Questions and answers
Where do I start when renting out a flat in Barcelona?
With the rent cap and the type of lease. In a stressed market zone the new rent is limited by the last rent paid for that flat over five years, and the type of lease, main residence or temporary, sets the term and the guarantees.
Where is the rental deposit paid in Barcelona?
To the Incasòl, within two months of signing the lease. For main-residence leases from 26 March 2026, the SERPAVI report is attached to the lease.
Can the owner charge the tenant the agency fee?
No. Article 20.2 of the LAU prohibits passing on to the tenant the agency and lease-drafting costs under any name. An optional extra service can be charged only if the tenant asked for it in writing.
Can I let the flat for a few months without restrictions?
No. Since 8 October 2026 a temporary lease requires a real, provable reason for the move, a term of more than 31 days and, as a rule, no more than 12 months. Without such a reason, the lease is treated as a main-residence lease from the beginning.
What changes for the owner from 15 November 2026?
Under RDL 28/2026 (BOE), a main-residence lease is extended by a further five (seven) years after the first five (seven) unless the parties give notice that they refuse. The owner's refusal, outside the cases listed in the law, requires compensation to the tenant. Congress has not yet validated the decree-law.
