Easements: rights that restrict how a property can be used

Some encumbrances appear in the nota simple; others emerge only during a technical survey or a neighbour dispute. We examine common servidumbres in dense Barcelona neighbourhoods.

A servidumbre, or easement, is a property right under which one property, the predio sirviente, bears a burden benefiting another, the predio dominante, or a particular person. The right attaches to the property rather than merely its current owner. It passes with a sale, and the new owner takes it on whether aware of it or not. Several types recur in Barcelona's dense urban fabric and directly affect renovation possibilities.

Rights of way

Servidumbre de paso is a right to cross someone else's land or premises where the beneficiary property would otherwise be inaccessible. It is common among inner courtyards and shared passages between older buildings. Part of a building may physically depend on access through neighbouring land, and the historic route may differ from what seems logical on a floor plan. A redesign altering internal passages or closing existing access must account for the right in advance, rather than after a neighbour complains or brings proceedings once works are complete.

Rights to light and views

Servidumbre de luces y vistas concerns windows and openings facing a neighbouring building's wall or courtyard. In densely built Ciutat Vella, one building's windows often face directly onto another's wall or patio. Established neighbouring rights may restrict blocking a window with a new wall or altering a façade facing a shared lightwell. Where renovation involves relocating or enlarging openings, this is an architectural issue as well as a legal one.

Medianería: the party wall

Medianería is the shared-wall arrangement between adjoining buildings. It has its own maintenance-cost rules: repairing the wall is a joint obligation rather than one neighbour's responsibility, with proportions governed separately from work inside an individual flat. Works that weaken or add loads to the wall—such as chasing for new wiring or fixing heavy structures—should be agreed with the neighbour in advance, even where the wall is formally shared rather than exclusively owned by one party.

Why this needs a separate due diligence check
