Stressed-Market Zones and Buying a High-Value House: What Changes
A stressed-market zone puts no ceiling on the price of buying a house. It affects rent, the 20% ITP for a buyer with five or more homes, and the Generalitat's tanteo when a company is the seller.
Buying a house in a stressed-market zone is not limited by price or by who the buyer is: there is no ceiling on the sale price and no general permit for the deal. The zone works in three places: on renting out the house, on the status of a buyer with five or more residential properties (ITP at 20% instead of the 10–13% scale), and on the Generalitat's right to buy a home from a corporate seller listed in the register of large holders. A zona de mercado residencial tensionado (stressed residential market zone) is a territory that the autonomous community declares as such for three years, with possible extension, under art. 18 of Ley 12/2023.
Are Sitges, Castelldefels, Sant Cugat and the Maresme in the zone?
Some of them are. The Catalan list was published in the BOE of 15 March 2024 on the basis of Generalitat resolution TER/800/2024. It names Barcelona, Sitges, Castelldefels, Sant Cugat del Vallès, Sant Pere de Ribes and, in the Maresme, Alella and Teià. The declaration runs for three years from the publication date, that is, until March 2027. In July 2026 the Generalitat proposed a new list of 302 municipalities, but according to Ara of 28 July 2026 this is a draft that the Ministry of Housing still has to approve. On the Generalitat page there were still two lists on 13.10.2026, under resolutions TER/800/2024 and TER/2408/2024. The current status of the list is checked on the date of the offer.
What does the zone change for a purchase, and what only for renting?
| Layer | What it regulates | Affects buying the house |
|---|---|---|
| Rent | Starting rent, renewal | Only if the house is let as a home |
| Gran tenedor status | ITP rate | Yes, if the buyer holds five or more residential properties |
| Tanteo y retracto (pre-emption right) | The Generalitat's right to buy the home | Only if the seller is a company on the register, or at an auction |
| Price and buyer eligibility | Nothing | No |
When does the buyer pay 20% ITP instead of the scale?
When the buyer is a gran tenedor (large holder) on the date of the deal. By the ATC clarification, that is an owner of more than 10 residential properties in Catalonia, or more than 1 500 m² of residential floor area, or five or more residential properties in municipalities with a stressed market. Garages and storage rooms do not count, nor does the property being bought, and the status is determined before the deal. On the same page, houses in tourist rental and homes held by companies that buy, renovate and resell are counted. The 20% rate has applied since 27.06.2025. It does not apply if the house is bought as a permanent home (ATC: residence for three years in a row) or as the buyer's headquarters.
Worked example, not a forecast: a resale purchase for 2 M€.
| Buyer status | ITP calculation | Amount |
|---|---|---|
| Ordinary | 165 000 € + 13% of 500 000 € above 1.5 M€ | 230 000 € |
| Gran tenedor | 20% of 2 M€ | 400 000 € |
The difference is 170 000 €. If the house is new and the seller is the developer, tax is calculated differently: IVA (VAT) and AJD (stamp duty) instead of ITP (IVA and ITP on new builds). On the rate itself: 20% ITP for a gran tenedor.
When can the Generalitat buy the house?
The range of transactions is set in art. 2.2 of Decret llei 1/2015 as amended by Ley 11/2025: the sale of any home in a stressed-market zone where the seller is a legal entity listed in the register of large holders, and homes sold at a court or administrative auction. Sales by private individuals are not on the list. Excluded are sales of a new home, or one after deep renovation, within one year of the cédula de habitabilidad (habitability certificate), and the first transfer of a new build within a group of companies.
A corporate seller must declare whether it is a large holder. If it declares otherwise, it needs a register certificate of the number of its homes on the day of the escritura (notarial deed), and this is requested before the arras (reservation deposit contract). According to the tramits.gencat.cat page (updated in 2021, before Ley 11/2025), the Generalitat communicates its decision within up to two months, and if it stays silent it is treated as having waived the right.
Ley 11/2025 also added a general wording in art. 15.2 of Ley 18/2007 on the Generalitat's right of tanteo when homes change hands in such zones. How this fits with the narrow list is a question for an abogado (lawyer). The city's own practice: Ajuntament tanteo.
What changes if the house is let?
If the house is let as a home, arts. 17.6 and 17.7 of the Ley de Arrendamientos Urbanos (urban lettings act) as amended by Ley 12/2023 apply: the starting rent may not exceed the last rent of the past five years, and for large holders and for homes with no contract in the past five years (in Catalonia, under the BOE resolution) the cap is set by the reference price index. Under art. 66 ter of Ley 18/2007, letting by the room may not cost more than letting the whole house. Ley 11/2025 is challenged before the Constitutional Court: the appeal was admitted in June 2026 and did not suspend the law (que.es, 16.06.2026). More on rent: rent cap in the zone.
Real Decreto-ley 29/2026 (BOE-A-2026-20823) has been in force since 8 October 2026, but on 13.10.2026 Congress had not ratified it, and if it refuses, its provisions lapse. Until 31 December 2030 it restricts buying homes below 70% of the estimated market value for corporate gran tenedor buyers and for companies that buy property well below valuation (art. 1), and it lets ayuntamientos (town councils) in stressed-market zones add up to 50% to the IBI (property tax) on homes left empty for more than two years without cause and on homes in tourist use. Whether it applies to a given purchase structure is a question for an abogado. Real Decreto-ley 28/2026 on the stability of lease contracts takes effect on 15 November 2026, with the same ratification status.
Who this analysis is not for
Anyone buying the house as their own permanent home: the 20% ITP does not apply. Anyone whose house is in a municipality outside the list: the layers above do not operate there, but the list changes. The decision on a specific house is made with an abogado and an asesor fiscal (tax adviser).
Ownership structure and buyer status can be discussed at a consultation; the formats are described on the residential property page.
Questions and answers
Is Sitges in the stressed-market zone?
Yes, it is named in the BOE list of 15 March 2024. The declaration runs until March 2027; a new list was proposed in July 2026, and on 13 October 2026 the Generalitat page still showed the two earlier lists.
Does the zone limit the price of buying a house?
No. The starting rent on letting is limited; there is no ceiling on the sale price. An exception to the general rule: RDL 29/2026 (not ratified) restricts buying below 70% of valuation for corporate gran tenedor buyers.
When does a buyer pay 20% ITP?
When, on the date of the deal, the buyer holds five or more residential properties in stressed-market municipalities, or more than 10 properties or more than 1 500 m² of residential area in Catalonia. Exception: the house is bought as a permanent home.
Can the Generalitat buy a house that I am buying from a private individual?
Under the list in art. 2.2 of Decret llei 1/2015 as amended by Ley 11/2025, sales by private individuals are not included. The general wording of art. 15.2 of Ley 18/2007 leaves the question to an abogado.
What should I ask a corporate seller for?
A declaration of large-holder status and, if it is negative, a register certificate of the number of homes on the day of the escritura. For a new house, also the date of the cédula.
