Subletting in Barcelona: what the law allows the owner
The law allows only partial subletting, with the owner's written consent and a rent no higher than the main lease. How it differs from assignment and from the owner letting rooms directly.
Subletting (subarriendo) is a contract under which a tenant lets part of the rented flat to a third party and remains the party to the main lease towards the owner. The Ley de Arrendamientos Urbanos (LAU, the Urban Leases Act) allows it only for part of the flat and only with the landlord's written consent, and the subtenant's rent may not be higher than the rent under the main lease. Article 8 stands in the wording in force since 1 January 1995; the October 2026 decree-laws did not change it (consolidated LAU).
What article 8 of the LAU allows
Article 8 sets four rules. The tenant can assign the whole lease only with the landlord's written consent. A flat can be sublet only in part, and again with written consent. The sublet rent may in no case exceed the rent under the lease. The subtenant's right ends together with the right of the tenant who granted it.
The key point follows from this: under article 8 a tenant cannot sublet the entire flat and move out, even with the owner's consent. That is already either an assignment of the lease or a new lease between the owner and the new occupant.
If the subtenant lives in the room as their home, the contract with the tenant is governed by the LAU rules on housing leases. If not, the terms are set by agreement between the parties.
How subletting differs from assignment and from letting rooms
Three arrangements are often confused, and the consequences of each differ.
| Arrangement | Who answers to the owner | Owner's consent | Limit on rent |
|---|---|---|---|
| Subletting part of the flat (subarriendo) | The original tenant | Written, mandatory | No higher than the rent under the main lease (art. 8.2) |
| Assignment of the lease (cesión) | The new tenant, who takes the previous tenant's place | Written, mandatory | The rent stays as under the lease |
| Owner letting rooms directly | Each occupant under their own contract | Not required, the owner is a party | The sum of the room rents may not exceed the rent for the whole flat (art. 17.9) |
The third arrangement has been named expressly in the law since 8 October 2026: under Real Decreto-ley 29/2026 (BOE), a housing lease also covers the lease of a single room, and the sum of the rents under room contracts in force at the same time may not exceed the rent for letting the whole flat under one contract. Congress has not yet validated the decree-law. For an owner who wants income from rooms, direct contracts are more transparent than a permitted sublet: the owner chooses the occupants and sees who lives in the flat.
What the owner can do about a sublet without consent
Subletting or assignment without consent is among the grounds on which the landlord may terminate the lease (art. 27.2 LAU). The same article has a second ground: the flat has stopped serving mainly as the home of the tenant or of those who are legally entitled to live there. It applies when the tenant has moved out and left the flat to other people.
Nightly letting through platforms is a separate case. Tourist use of housing is taken out of the LAU (art. 5.e), and in Catalonia, in the 262 municipalities with housing access problems, a new tourist dwelling needs a municipal planning licence and a tourist authorisation before opening (Canal Empresa, Decret llei 3/2023). A tenant who lets a room to tourists breaks the lease and the tourism rules. The outlook for licences in Barcelona is covered in the article on tourist licences up to 2028.
What to do if you suspect a sublet:
- Do not enter the flat without the tenant's consent: that creates risks for the owner.
- Ask the tenant in writing who actually lives in the flat.
- Check listing portals and tourist platforms for adverts of a room or the flat at that address, and keep copies.
- Take what you have gathered to an abogado (lawyer), who will assess the grounds for termination from the text of the lease.
What to put in the lease
The wording "in accordance with the law" adds almost nothing. Direct clauses work:
- a ban on subletting and assignment without prior written consent, attached to the lease as an annex;
- a separate ban on nightly and tourist letting through any platform;
- the tenant's duty to say who lives permanently in the flat;
- if subletting is allowed, which room, to whom and for how long, with a reminder of the rent cap in article 8.
The remaining steps of letting out are collected in the article on where an owner should start.
When subletting does not fit
A permitted sublet suits an owner poorly if control over the occupants matters: the subtenant does not go through the owner's checks and does not sign a contract with the owner. It does not suit a tenant who plans to leave for good: it is more honest then to agree on an assignment or a new lease. Take particular care with a company tenant that plans to house different employees in the flat; that arrangement is covered in the article on renting a flat to a company.
Questions and answers
Can the whole rented flat be sublet with the owner's consent?
Under article 8 of the LAU, no: only partial subletting is allowed. If the tenant wants to hand the entire flat to another person, that is an assignment of the lease or a new lease, and both also need the owner's written consent.
How much can a tenant charge for a sublet room?
No more than corresponds to the rent under the main lease: article 8.2 of the LAU forbids exceeding it in any case. How to split the rent for a part of the flat is best recorded in the owner's written consent.
What happens if the tenant let a room without consent?
The owner may terminate the lease under article 27.2 of the LAU. The procedure depends on the text of the lease and the evidence, so the decision is made with an abogado.
Can a tenant let a room to tourists by the night?
No. Tourist use of housing is outside the LAU and in Catalonia needs separate permits that the tenant, as a rule, does not have. It breaches the lease and the tourism rules.
