The 30% VPO Quota and the Economics of a Building Project in Barcelona
The 30% quota takes 14–19% of the sum of the apartments at a market price of 5,500–8,000 €/m², since protected units sell at no more than 2,913.18 €/m². The loss comes off the building price.
The 30% protected housing quota turns part of a building's apartments into housing with a price cap: in 2026 the maximum sale price for the general regime is 2,913.18 €/m² of usable area (Generalitat). In the worked example, over 1,800 m² this takes 14–19% of the sum of the apartments at a market price of 5,500–8,000 €/m², and the loss has to be deducted from the building price before an offer. The rules were checked as of 12 October 2026.
Which projects fall under the quota
The rule has applied in Barcelona since 14 December 2018: in developments over 600 m² of sostre (floor area), built or under construction, 30% goes to housing with state protection (VPO, vivienda de protección oficial). It covers new construction and full refurbishment of a building, not partial refurbishments. Protected housing is in the general regime and falls under the city administration's tanteo and retracto (rights of first refusal and buy-back) (Ajuntament). The buyers are people from the Registre de sol·licitants d'HPO (register of protected housing applicants), within income limits. The Supreme Court confirmed the quota (STS 110/2026 of 5.02.2026, per the Ecija analysis), covered in the article on the confirmation of the quota.
The quota is counted from area (sostre), not from the number of apartments: that is how the Ajuntament describes it ("30% de superfície") and how analyses of the Supreme Court decision do ("30% del techo"). But the Ajuntament press release also contains a wording about 30% of apartments, so the conversion of area into apartments, rounding and the exceptions (buildings with protection A–C where the layout of apartments is preserved, and zones with an HPO reservation already set) are checked in the text of the plan amendment and with an Ajuntament technician before the offer.
What a protected apartment costs in 2026
The maximum prices of new apartments have applied since 1 January 2026 as a single module with no geographic zones (Instrucció 1/2026 of the Agència de l'Habitatge). The modules are updated, so figures are taken as of the licence date.
| Regime | Sale, €/m² | Sale of annexes, €/m² | Rent, €/m² |
|---|---|---|---|
| General | 2,913.18 | 1,456.59 | 10.93 |
| Special | 2,560.42 | 1,280.20 | 9.61 |
| Preu concertat (agreed price) | 3,001.68 | 1,200.67 | 10.93 |
For the quota, the Ajuntament points to the general regime. The rent period is not labelled on the Generalitat page; a monthly rate is assumed in the calculation.
How much the quota takes from the sum of the apartments
Worked example, not a forecast. The building has 1,800 m² of usable area, and 30% is 540 m². The market price in the example is also given per usable area. The loss equals 540 × (market price minus 2,913.18 €/m²). The price of 6,800 €/m² is taken from the article on dividing a building into apartments, and the other two are for comparison.
| Market, €/m² | Sum of apartments, € | Loss from the quota, € | % of the sum | % of a 10 M€ building price |
|---|---|---|---|---|
| 5,500 | 9,900,000 | 1,396,883 | 14.1 | 14.0 |
| 6,800 | 12,240,000 | 2,098,883 | 17.1 | 21.0 |
| 8,000 | 14,400,000 | 2,746,883 | 19.1 | 27.5 |
The loss grows with the market price: the pricier the district, the bigger the gap between the market and the cap. Protected apartments can also be let. But 540 m² at 10.93 € gives 70,826 € a year before costs, and at a net margin of 70% and a capitalisation of 4.40% (C&W, the best decentralised segment in Barcelona, second quarter 2026) that is about 1.13 M€, less than the proceeds from selling 540 m² at the cap (1.573117 M€).
How the quota gets into the purchase price
The building price that can be offered equals the sum of the apartments at market minus the loss from the quota, minus taxes, works and margin. In the article on dividing a building, the difference between the sum of the apartments (12.24 M€) and the building price (10 M€) was 2.24 M€, and almost all of it went on ITP. The quota takes another 2.098883 M€: that leaves 141,117 € against ITP of 2 M€, so the calculation goes negative. This is not a price forecast but a way to test an offer for robustness.
The purchase tax does not go away: the residential part of a whole building held by one buyer bears ITP at 20% (ATC), more in the article on buying an apartment building.
What to establish before an offer
- Whether the sostre is over 600 m² and whether the refurbishment is full: a partial refurbishment does not fall under the quota, but the boundary is defined by the project.
- How to convert 30% of area into a number of apartments and how it is rounded.
- Which regime and which prices apply on the licence date, allowing for indexation.
- To whom and how to sell: buyers from the register and the Ajuntament's tanteo affect the timeline.
- Obtain an arquitecto's opinion on how the quota applies to the project: without it the calculation remains an assumption.
When the calculation does not apply
The calculation does not apply to projects under 600 m² of sostre or to partial refurbishment. It does not answer the question of what apartment prices will be in a year either: the table counts the gap at a given price. DNPI Capital has no completed projects involving whole buildings; the completed ones are the plot in Sitges and the apartment on Compte de Urgel; this is a method, not a result.
Next step: build the quota into the investor calculator as a separate line. How the quota affects letting is in the article on build-to-rent.
Questions and answers
What is the 30% VPO quota in Barcelona?
A rule since 2018: in developments over 600 m² of sostre, new or fully refurbished, 30% goes to housing with state protection in the general regime (Ajuntament).
What is the maximum price of a protected apartment in 2026?
For the general regime 2,913.18 €/m² (Generalitat). For the special regime 2,560.42 €/m², for preu concertat 3,001.68 €/m².
Does partial renovation fall under the quota?
No. The Ajuntament names only new construction and full refurbishment. The boundary between them is defined by the project.
Can protected apartments be let instead of sold?
For protected housing the Generalitat publishes both the sale price and the rent: 10.93 €/m² in the general regime. In the article's calculation, selling at the cap gives more than letting.
